Bengaluru: A 17-year-old Dalit schoolboy in Karnataka’s Bidar was thrashed by members of a right-wing organisation after he shared a picture of Lord Rama and Hanuman with a note that they were not gods. Police have registered a case and arrested three accused. One of the accused it at large. According to police, the accused have been charged under relevant sections of the Indian Penal Code and the SC/ST (Prevention of Atrocities) Act.

The incident, police said, took place at Humnabad circle area in Bidar on Monday, when a grand consecration ceremony was held at the Ram Temple in Ayodhya.
The accused filmed the incident and circulated it on the social media. The video shows the schoolboy surrounded by several people sporting saffron scarves. As soon as he gets off an auto-rickshaw, he is slapped by one of the men surrounding him. The visuals then show him being taken inside a temple. The boy is seen prostrating before the deity as the others stand around him. In another frame, they are seen checking the minor’s phone.
Police registered a case on Tuesday after the video shared by the accused went viral.

Now, women, SC/ST communities to get pension after 50 years of age in Jharkhand

RANCHI: In a first-of-its-kind initiative, the Jharkhand Cabinet on Wednesday gave its approval to the proposal for reducing the age limits for giving old age pensions to the tribals, dalit and women of all categories from 60 to 50 years.
The Cabinet meeting, headed by Chief Minister Hemant Soren, approved as many as 25 proposals, including the upgrading 140 middle schools to high schools all over the state.
Around 6 lakh women are estimated to benefit from the scheme and ₹22.2 crore has been approved for the scheme in the current fiscal, said Dadel.
According to CM Soren, Adivasi and Dalit do not get work at the age of 50, and hence, efforts are being made by his government to find out how to preserve and keep them safe.
Earlier on the completion of four years of his government, Chief Minister Hemant Soren had announced that the Adivasi and Dalit people would get old age pension at the age of 50 years and not at the age of 60 years. According to Soren, only 16 lakh people in the state had received pension benefits in 20 years since the formation of Jharkhand in 2000.
The number of beneficiaries has increased under the JMM-led government and it now provides pensions to 36 lakh people, the chief minister claimed.
In another important decision, approval was given to increase home loans given to government employees from Rs 30 lakh to Rs 60 lakh. This loan will be given at a 7.5 per cent interest rate. At the same time, the requirement of keeping the property as a mortgage against the loan will also be removed.
The Cabinet also gave its approval for giving relaxation of seven years to the candidates appearing for the Jharkhand Public Service Combined Civil Services Examination – 2023. The cutoff date for this examination has been fixed to August 1, 2017.

रांची: अपनी तरह की पहली पहल में, झारखंड कैबिनेट ने बुधवार को आदिवासियों, दलितों और सभी श्रेणियों की महिलाओं को वृद्धावस्था पेंशन देने की आयु सीमा 60 से घटाकर 50 वर्ष करने के प्रस्ताव को मंजूरी दे दी।
मुख्यमंत्री हेमंत सोरेन की अध्यक्षता में कैबिनेट की बैठक में राज्य भर के 140 मध्य विद्यालयों को उच्च विद्यालयों में अपग्रेड करने सहित 25 प्रस्तावों को मंजूरी दी गई।
कैबिनेट सचिव वंदना डाडेल ने कहा, "एक महत्वपूर्ण निर्णय में, उन सभी महिलाओं और अनुसूचित जाति और अनुसूचित जनजाति के लोगों को, जो 50 वर्ष की आयु प्राप्त कर चुके हैं, अब राज्य सरकार की वृद्धावस्था पेंशन योजना के तहत वृद्धावस्था पेंशन मिलेगी।"

सीएम सोरेन के मुताबिक, आदिवासी और दलित को 50 साल की उम्र में काम नहीं मिलता है, इसलिए उन्हें कैसे संरक्षित और सुरक्षित रखा जाए, इसके लिए उनकी सरकार की ओर से कोशिश की जा रही है.
इससे पहले अपनी सरकार के चार साल पूरे होने पर मुख्यमंत्री हेमंत सोरेन ने घोषणा की थी कि आदिवासी और दलित लोगों को 60 साल की उम्र में नहीं बल्कि 50 साल की उम्र में वृद्धावस्था पेंशन मिलेगी. सोरेन के अनुसार, 2000 में झारखंड के गठन के बाद से 20 वर्षों में राज्य में केवल 16 लाख लोगों को पेंशन लाभ मिला है।
मुख्यमंत्री ने दावा किया कि झामुमो के नेतृत्व वाली सरकार के तहत लाभार्थियों की संख्या में वृद्धि हुई है और यह अब 36 लाख लोगों को पेंशन प्रदान करती है।
एक अन्य अहम फैसले में सरकारी कर्मचारियों को दिए जाने वाले होम लोन को 30 लाख रुपये से बढ़ाकर 60 लाख रुपये करने को मंजूरी दी गई. यह लोन 7.5 फीसदी ब्याज दर पर दिया जाएगा. साथ ही लोन के एवज में संपत्ति को बंधक रखने की जरूरत भी खत्म हो जाएगी.
कैबिनेट ने झारखंड लोक सेवा संयुक्त सिविल सेवा परीक्षा-2023 में शामिल होने वाले अभ्यर्थियों को सात साल की छूट देने को भी मंजूरी दे दी. इस परीक्षा के लिए कटऑफ तिथि 1 अगस्त, 2017 तय की गई है.

Missing Numbers: Corrosive Impact Of Privatisation Of Education And Healthcare On Dalits And Adivasis

Oxfam’s study indicates that the trend of private school enrolment among Dalit and Adivasi children has been decreasing over time, exacerbating the gap between these groups and Upper Castes.

In recent years, the growth of private schools in India has been significant, with their share in elementary education increasing from 19.49 per cent in 2007-08 to 28 per cent in 2020. According to Oxfam India, this surge has not resulted in more equitable enrolment patterns, particularly among marginalised communities. Scheduled Tribes (ST) children, with a participation rate of 12.7 per cent, exhibit the lowest involvement in private schooling, followed by kids from the Scheduled Castes (SC) and Other Backward Classes (OBCs). Oxfam’s study indicates that the trend of private school enrolment among Dalit and Adivasi children has been decreasing over time, exacerbating the gap between these groups and Upper Castes. The language of merit, ability and hard work that dominates elite private schools is shaped by class, gender and caste.
Over the years, this pattern has gained momentum, posing a risk of further widening disparity between Dalit and Adivasi communities and Upper Castes. The proliferation of private schools in India has failed to yield more inclusive enrolment trends across gender, caste and class lines. Particularly in rural regions, the surge in private schools and enrolment seems to perpetuate the existing social, economic and demographic norms instead of creating fresh opportunities for India’s marginalised communities. While some caste disparities in urban areas may have seen improvement at lower primary levels, there is a lack of consistent backing for private enrolment to become genuinely equitable over time. A market-mediated education system inherently tilts against the socially marginalised, perpetuating skewed access and opportunities. Oxfam India’s report suggests that 37 per cent of children from SCs faced harassment or abuse by either school staff or their peers during the pandemic.
Kerala stands out – highest in quality and lowest in dropout rate
The Kerala model of public education presents a different picture. In the 2019 NITI Aayog report evaluating the quality of school education across 20 large states, Kerala has clinched the top spot, showcasing exemplary performance. (On the flip side, Uttar Pradesh, despite being the most populous state, has landed at the bottom of the rankings for the academic year 2016-17).
According to the periodic economic reviews of the Government of Kerala, there is a reverse trend of students going back to government schools over the past five years. Compared to previous years, around 2,56,448 new students sought admissions in government and government-aided schools in Kerala in the academic year 2021-22. The corresponding number for the year 2022-23 is 82,448. (This decline in number is due to the decline in birth rate according to the Govt) Over the past five years 8,16,929 new students have enrolled in government schools. In Kerala too, the percentage of SC and ST students in government schools is higher than that of aided and unaided schools. The percentage of SC students in government schools, government aided schools and private unaided schools are 12.17 per cent, 9.40 per cent, and 3.67 per cent respectively.
Kerala has achieved the distinction of having the lowest dropout rate of school students among the Indian states, both in the general as well as the SC/ST category. In the year 2020-21, dropout ratio among school students in Kerala was 0.04 per cent, as per the Ministry of Human Resources. The dropout ratio of SC and ST students has significantly declined over the years. The drop-out ratio among SC students in Kerala has declined in 2021-22 as 0.04 per cent and that of ST students also declined as 0.30 per cent.
Oxfam India has recommended regulatory measures to address discrimination against Dalits and Adivasis in private schools and emphasised the need to strengthen the public education system by allocating 6 per cent of GDP to education. Despite the growth in private schools, their impact on learning outcomes remains ambiguous, and teacher bias in student evaluations persists. In essence, the privatisation of education threatens to perpetuate social inequalities rather than breaking down existing barriers of class, caste, and gender in Indian society.
Privatisation of Healthcare and its impact on marginalised communities
Oxfam has also highlighted the impact of privatisation of healthcare on India’s Dalits and tribals. They experience significantly disparate health outcomes, living shorter lives of lower quality. “A Dalit woman lives, on average fifteen years less than the upper caste Hindu woman. About 65 per cent of ST women suffered from anaemia compared to 47.6 per cent of non-ST women. They miss out on access to healthcare. While 15 per cent of higher caste women did not receive prenatal care, such care was not received by 26 per cent of Dalit women. Only about 61% of ST mothers received the tetanus vaccination, compared to 81 per cent of non-SC/ST women”, states Oxfam’s report.
The dominance of private infrastructure, constituting approximately 62 per cent of India’s health infrastructure, necessitates a critical examination of its responsiveness to these communities. Only 4 per cent of Adivasis and 15 per cent of Dalits seek healthcare from private facilities, according to Oxfam India. Notably, the 75th round of NSSO indicates that out-of-pocket expenditure for inpatient care in private facilities is 524 per cent higher than in public facilities. This poses a significant burden, particularly.
Oxfam India finds that despite expectations that health insurance would address the high healthcare costs, only 1.6 per cent and 4 per cent of private hospital admissions under PMJAY were from Dalits and Adivasis, falling significantly short of their projected eligible population share. Moreover, private hospitals, predominantly situated in urban areas, aggravate the existing infrastructure gaps in rural regions inhabited by Adivasi and Dalit populations. Discrimination persists in the private healthcare system, including disparate care, denial of entry, and extended waiting times for Dalits and Adivasis.
The representation of these communities in the leadership of the medical profession is also notably low, and social accountability remains limited in the private sector. Weak regulatory mechanisms and insufficient implementation of key provisions further compound these challenges. The policy brief proposes recommendations to foster equity, accountability, and address the specific concerns of SC and ST communities in the private health sector.

Court orders further probe into Dalit youth’s suicide in 2017 after release from police custody

Father says Vinayakan from Engandiyur was brutally tortured by two civil police officers in the Pavaratty station
The Thrissur SC/ST Court on Wednesday ordered further investigation into the death of Vinayakan, an 18-year-old Dalit youth from Engandiyur who committed suicide in July 2017, allegedly following custodial torture at the Pavaratty police station.
The court ordered further investigation following a complaint filed by Vinayakan’s father C.K. Krishnan.
Vinayakan, who was speaking to one of his friends, was taken into custody by the police. “He was brutally tortured by two civil police officers in the Pavaratty station. They alleged that Vinayakan was behind the theft of a gold chain that happened in the area around that time. The police also threatened to charge him with many undetected chain-snatching cases in the station limits. Vinayakan was subjected to brutal physical torture, mental harassment, and insult, which he couldn’t bear,” said Mr. Krishnan in his complaint.
Vinayakan, who was released from police custody, committed suicide at his house.
The case registered by the Vadanappally police was later handed over to the Crime Branch.
“Though the family demanded to charge abetment of suicide against two civil police officers in the Pavaratty police station, the investigation officer deliberately avoided Section 306 in the final report to rescue the accused,” alleged a Janakeeya Samara Samiti.

പാവറട്ടി പോലീസ് സ്റ്റേഷനിലെ കസ്റ്റഡി പീഡനത്തെ തുടർന്ന് 2017 ജൂലൈയിൽ ആത്മഹത്യ ചെയ്ത ഏങ്ങണ്ടിയൂർ സ്വദേശി വിനായകൻ എന്ന 18 കാരനായ ദളിത് യുവാവിന്റെ മരണത്തിൽ തുടരന്വേഷണത്തിന് തൃശൂർ എസ്സി/എസ്ടി കോടതി ബുധനാഴ്ച ഉത്തരവിട്ടു.
വിനായകന്റെ പിതാവ് സികെ കൃഷ്ണൻ നൽകിയ പരാതിയെ തുടർന്നാണ് കോടതി തുടരന്വേഷണത്തിന് ഉത്തരവിട്ടത്.
സുഹൃത്തുക്കളിൽ ഒരാളുമായി സംസാരിച്ചുകൊണ്ടിരുന്ന വിനായകനെ പോലീസ് കസ്റ്റഡിയിലെടുത്തു. പാവറട്ടി സ്റ്റേഷനിലെ രണ്ട് സിവിൽ പോലീസ് ഓഫീസർമാരാൽ ക്രൂരമായി പീഡിപ്പിക്കപ്പെട്ടു. അക്കാലത്ത് പ്രദേശത്ത് നടന്ന സ്വർണ ചെയിൻ മോഷണത്തിന് പിന്നിൽ വിനായകനാണെന്ന് ഇവർ ആരോപിച്ചു. സ്റ്റേഷൻ പരിധിയിൽ പിടികിട്ടാത്ത നിരവധി ചെയിൻ തട്ടിപ്പ് കേസുകൾ ചുമത്തുമെന്നും പോലീസ് ഭീഷണിപ്പെടുത്തി. ക്രൂരമായ ശാരീരിക പീഡനവും മാനസിക പീഡനവും അപമാനവും സഹിക്കാനാകാതെയാണ് വിനായകൻ നേരിടേണ്ടി വന്നത്,” ശ്രീകൃഷ്ണൻ തന്റെ പരാതിയിൽ പറഞ്ഞു.

OBCs, Dalits should assert themselves in Lok Sabha polls, says Prakash Ambedkar
Vanchit Bahujan Aghadi chief Prakash Ambedkar’s remark urging OBCs and Dalits to fight for their political rights came amid OBC outfits announcing they would hold a rally at Azad Maidan on January 26 to protest the inclusion of Maratha reservation within the OBC category.

Vanchit Bahujan Aghadi (VBA) president Prakash Ambedkar on Thursday urged the Other Backward Class (OBC) communities and Dalits in Maharashtra to fight for their political rights in the upcoming Lok Sabha polls.
Ambedkar’s statement came even as OBC outfits announced that they would hold a rally at Mumbai’s Azad Maidan on January 26 to protest the inclusion of Maratha reservation within the OBC category.
“It is not just a fight between OBCs and Marathas. It is a larger battle to reassert the rights of OBCs and Dalits. We have to unite and fight to save the Constitution, reservation and representation in the political system,” Ambedkar told The Indian Express. “The OBCs, tribals, Dalits and oppressed segments within Marathas together make up for 80 per cent of the population. Why should they be subjected to exploitation?” he added.
Exhorting people to learn to make a clear distinction between those in favour of reservation and those against, Ambedkar said, “Do not get swayed by the government’s false promises. Do not get carried away by their narratives.”
The battle lines have to be drawn, Ambedkar said. “All mainstream parties are getting elected using OBC/Dalit vote banks. But why is it that OBCs and Dalits do not get adequate representation in politics? Why is there only a symbolic representation of these communities in Parliament and Assembly?” Ambedkar asked.

“It is high time OBCs/Dalits assert themselves. In the Lok Sabha polls, they should ensure their vote goes to OBCs/Dalits. Unless such hard decisions are taken, OBCs and Dalits will be subjected to playing a secondary role in mainstream politics,” he said.
“Even within Marathas, there are two categories; one which is rich and politically dominant and the other is poor and neglected,” Ambedkar said, adding that he fears the rich and established Maratha class is using reservation politics to serve its vested interests.
“There are 169 well-established Maratha families that control the entire economy and politics in the state. They are all interlinked through relations,” he alleged, adding, “When we raise a voice against the exploitation of OBCs/Dalits, we also are concerned about these poor Marathas. We consider them as ‘Vanchit’ (deprived).”
Ambedkar’s remarks come at a time when OBC organisations in Maharashtra have decided to undertake a consolidation drive to put up a united front and showcase their political might to counter the growing clamour for Maratha reservation.
OBC Jan Manch president Prakash Shendge said, “We are holding a rally at Azad Maidan on January 26. We have appealed to OBCs to come in large numbers to raise their concerns and fight for their rights.”
“Our battle is not against any individual or community. Our objection is to Maratha reservation under the OBC category. Everybody knows Marathas are a dominant community. Till now they flaunted their forward caste. Suddenly, they are now seeking reservation. They are insisting on reservation within the OBC category. This cannot be tolerated,” Shendge told The Indian Express.
The OBC outfits’ rally will be held on a day when Maratha quota activist Manoj Jarange-Patil is also holding a rally in the city. OBC leaders are angry that the state government has agreed to all the demands made by Jarange-Patil. Chief Minister Eknath Shinde’s promise to Jarange-Patil that the survey to identify Kunbis will be concluded in seven days has also upset the OBC leaders who say this is a hasty decision to please Marathas and leaves ample scope for manipulation.

वंचित बहुजन आघाडीचे प्रमुख प्रकाश आंबेडकर यांनी ओबीसी आणि दलितांना त्यांच्या राजकीय हक्कांसाठी लढण्याचे आवाहन केल्याचे वक्तव्य ओबीसी संघटनांनी 26 जानेवारीला मराठा आरक्षणाचा ओबीसी प्रवर्गात समावेश केल्याच्या निषेधार्थ आझाद मैदानावर रॅली काढणार असल्याची घोषणा केली होती.

आगामी लोकसभा निवडणुकीत महाराष्ट्रातील इतर मागासवर्गीय (ओबीसी) समुदाय आणि दलितांना त्यांच्या राजकीय हक्कांसाठी लढण्याचे आवाहन वंचित बहुजन आघाडी (VBA) अध्यक्ष प्रकाश आंबेडकर यांनी गुरुवारी केले.
ओबीसी संघटनांनी मराठा आरक्षणाचा ओबीसी प्रवर्गात समावेश केल्याच्या निषेधार्थ २६ जानेवारीला मुंबईच्या आझाद मैदानावर रॅली काढण्याची घोषणा केली असतानाच आंबेडकरांचे विधान आले .
“ही फक्त ओबीसी आणि मराठा यांच्यातली लढाई नाही. ओबीसी आणि दलितांचे हक्क पुन्हा मिळवून देण्याची ही मोठी लढाई आहे. संविधान, आरक्षण आणि राजकीय व्यवस्थेतील प्रतिनिधित्व वाचवण्यासाठी आपल्याला संघटित होऊन लढावे लागेल, असे आंबेडकर यांनी इंडियन एक्सप्रेसला सांगितले . “मराठ्यांमध्ये ओबीसी, आदिवासी, दलित आणि शोषित वर्ग मिळून 80 टक्के लोकसंख्या आहे. त्यांचे शोषण का व्हावे?” तो जोडला.
आरक्षणाच्या बाजूने आणि विरोधात असणारे यांच्यात स्पष्ट फरक करायला शिका, असे आवाहन करून आंबेडकर म्हणाले, “सरकारच्या खोट्या आश्वासनांना बळी पडू नका. त्यांच्या कथनात वाहून जाऊ नका.”
लढाईच्या रेषा आखायच्या आहेत, असे आंबेडकर म्हणाले. “सर्व मुख्य प्रवाहातील पक्ष ओबीसी/दलित व्होट बँक वापरून निवडून येत आहेत. पण राजकारणात ओबीसी आणि दलितांना पुरेसे प्रतिनिधित्व का मिळत नाही? संसद आणि विधानसभेत या समुदायांचे केवळ प्रतीकात्मक प्रतिनिधित्व का आहे? असा सवाल आंबेडकरांनी केला.

“ओबीसी/दलितांनी स्वतःला ठामपणे सांगण्याची हीच वेळ आहे. लोकसभा निवडणुकीत त्यांनी आपले मत ओबीसी/दलितांना जाईल याची खात्री करावी. असे कठोर निर्णय न घेतल्यास, ओबीसी आणि दलितांना मुख्य प्रवाहातील राजकारणात दुय्यम भूमिका बजावली जाईल,” ते म्हणाले.
“मराठ्यांमध्येही दोन वर्ग आहेत; एक श्रीमंत आणि राजकीयदृष्ट्या वरचढ आहे आणि दुसरा गरीब आणि उपेक्षित आहे,” असे आंबेडकर म्हणाले, श्रीमंत आणि प्रस्थापित मराठा वर्ग आरक्षणाच्या राजकारणाचा वापर आपल्या निहित स्वार्थासाठी करत असल्याची त्यांना भीती वाटते.
“राज्यातील संपूर्ण अर्थव्यवस्था आणि राजकारणावर नियंत्रण ठेवणारी 169 सुस्थापित मराठा कुटुंबे आहेत. ते सर्व नातेसंबंधातून एकमेकांशी जोडलेले आहेत,” असा आरोप करून ते पुढे म्हणाले, “जेव्हा आपण ओबीसी/दलितांच्या शोषणाविरुद्ध आवाज उठवतो तेव्हा आपल्याला या गरीब मराठ्यांचीही काळजी वाटते. आम्ही त्यांना 'वंचित' (वंचित) मानतो.
आंबेडकरांचे भाष्य अशा वेळी आले आहे जेव्हा महाराष्ट्रातील ओबीसी संघटनांनी मराठा आरक्षणाच्या वाढत्या कोलाहलाला तोंड देण्यासाठी एकत्रित आघाडी उभारण्यासाठी आणि त्यांचे राजकीय सामर्थ्य दाखवण्यासाठी एकत्रीकरण मोहीम हाती घेण्याचा निर्णय घेतला आहे.
ओबीसी जनमंचचे अध्यक्ष प्रकाश शेंडगे म्हणाले, "आम्ही २६ जानेवारीला आझाद मैदानावर रॅली काढत आहोत. आम्ही ओबीसींनी मोठ्या संख्येने आपल्या समस्या मांडण्यासाठी आणि हक्कासाठी लढा देण्याचे आवाहन केले आहे."
“आमची लढाई कोणत्याही व्यक्ती किंवा समुदायाविरुद्ध नाही. आमचा आक्षेप ओबीसी प्रवर्गातील मराठा आरक्षणाला आहे. मराठा हा प्रबळ समाज आहे हे सर्वांना माहीत आहे. आत्तापर्यंत त्यांनी आपली पुढारी जात दाखवली. अचानक ते आता आरक्षण मागत आहेत. ते ओबीसी प्रवर्गात आरक्षणासाठी आग्रही आहेत. हे सहन केले जाऊ शकत नाही,” शेंडगे यांनी इंडियन एक्सप्रेसला सांगितले.
ज्या दिवशी मराठा आरक्षणाचे कार्यकर्ते मनोज जरंगे-पाटील यांचाही शहरात मेळावा होत आहे त्याच दिवशी ओबीसी संघटनांचा मेळावा होणार आहे. जरंगे-पाटील यांनी केलेल्या सर्व मागण्या राज्य सरकारने मान्य केल्याने ओबीसी नेते संतप्त झाले आहेत. कुणबी ओळखण्यासाठीचे सर्वेक्षण सात दिवसांत पूर्ण केले जाईल, असे मुख्यमंत्री एकनाथ शिंदे यांनी जरंगे-पाटील यांना दिलेल्या आश्वासनामुळे मराठ्यांना खूष करण्याचा हा घाईचा निर्णय असल्याचे सांगणारे आणि हेराफेरीला भरपूर वाव असल्याचे सांगणारे ओबीसी नेतेही नाराज झाले आहेत.

The son and daughter-in-law of Pallavaram DMK MLA I Karunanithi are in the dock for allegedly torturing and inflicting severe physical and sexual assault on an 18-year-old Dalit girl, who was employed as a housekeeper at their Chennai residence. Thiruvanmiyur police have filed a First Information Report (FIR) against the accused persons, Anto and Merlina, largely outlining Indian Penal Code (IPC) sections concerning criminal intimidation, voluntarily inflicting hurt, and punishment for offensive atrocities under the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. But sections under Protection of Children from Sexual Offences (POCSO) Act have been omitted, although the survivor was abused from the age of 17. Activists point out that sexual assault sections are also missing from the FIR and the SC/ST Act sections cited are inadequate, given the extent of the torture that the girl has alleged
TNM accessed the said FIR, in which the complainant Anu (name changed) has detailed how the accused Merlina forced her to disrobe, before repeatedly hitting her on her private parts. Anu also said that Merlina often subjected her to violence at home, including by attacking her with utensils. The complaint said she also once made Anu clean out leftovers from the sink using her mouth and made her eat chillies as a punishment. The accused also turned the CCTV cameras off before allegedly committing these acts that amounted to sexual assault and torture.

“This is a weak FIR,” said activist Kathir from Evidence, a Human Rights NGO. “Sections of PoA are inadequate. Only sections 3(1)(r) and 3(1)(s) of the Act have been evoked. The FIR should have also evoked section 3(2)(v) of the PoA, given the extent of torture inflicted on the girl. Further, IPC sections 319 (hurt), 320 (grievous hurt), and 354 (whoever assaults or uses criminal force to outrage the modesty of a woman) should have also been invoked. This FIR is a clear indication of dereliction of duty by the police,” he said.

AB Karl Marx Siddharthar, advocate and publisher, said Section 3(1)(e) under the PoA Act is also applicable, since the survivor has said that she was assaulted after being asked to remove all her clothes. “It was not just Anto and Merlina who inflicted atrocities on the girl. It has also been done by the Investigative Officer (IO) who neglected their duty and filed a complete eyewash of an FIR. Action must be initiated against the IO as per Section 4 of the SC/ST act,” he added.
Noting that the survivor was a minor until a month ago, child rights activist Devaneyan said the accused should be booked under both POCSO and the Juvenile Justice Act. “Besides subjecting her to cruelty and torture, they have also violated her need of care and protection. Also, even after the media reported on the incident, the police waited to file an FIR. Their excuse was that they hadn’t received a complaint from the survivor. Why should they wait? The police can take suo-motu action. Would they have waited if the survivor was, say, the grandchild of the DMK MLA?” he asked.
Devaneyan added that the family of the girl should also be offered protection by the government, and further demanded that the state support her higher education.
TNM contacted Neelankarai’s Assistant Commissioner of Police (ACP), A Bharath, who said that sexual assault sections were not invoked because the accused was a woman. However, IPC Section 354 states that “whoever assaults a woman” to outrage her modesty can be booked.
On Tuesday, January 23, Merlina released an audio statement stating that all the allegations against her and her husband were fake. Earlier, on Sunday, Anto also released a similar audio statement.
