Added here, Amrit Mann’s father Sarbjeet Singh, made a fake SC certificate to get a government job as a math teacher reserved for the SC category in 1989. The incident came to light after retired Punjab officer Avtar Singh Sahota submitted a complaint to CM Bhagwant Mann alleging that Sarbjeet got the job on a fake SC certificate and worked for over 34 years.

Ranchi- In response to Congress leader Rahul Gandhi’s pledge to recognize the Sarna Code if his party comes to power, Salkhan Murmu, former MP and president of the Adivasi Sengel Abhiyan, emphasized the need for concrete actions to back up the announcement. Murmu welcomed Gandhi’s statement but insisted that mere announcements are not sufficient to gain the trust of the tribal populace.
It is noteworthy that Rahul Gandhi addressed a public rally in Ranchi during the Bharat Jodo Nyay Yatra on Monday. Gandhi slammed the BJP government over the recent political developments in Jharkhand and alleged that the party tried to topple the government as the chief minister was a tribal. He said that Congress would support and strive for the recognition of Sarna Dharma Code.
Speaking to The Mooknayak, Salkhan Murmu stressed that the Congress Party must raise the Sarna Code issue in the current Parliament session and take proactive steps, such as presenting a memorandum on Sarna to the President and organizing a national public meeting led by Rahul Gandhi. He highlighted the historical context, pointing out that the separate religion code for tribals was removed by the Congress government itself in the 1951 census.
“On the other hand, Sengel has given an ultimatum to the BJP central government until March 31, 2024. If the recognition of the Sarna Dharma Code is not announced, then there will be a Bharat Bandh on April 7, 2024, and railway and road traffic will be disrupted. The Adivasi Sengel Abhiyan, along with other tribal organizations, will continue the movement until the Sarna Dharma code of the nature-worshipping tribals is achieved,” he further said.
Rahul Gandhi, during a public rally in Ranchi as part of the Bharat Jodo Nyay Yatra, vowed to conduct a nationwide caste census and remove the 50 per cent cap on reservation if the opposition’s INDIA bloc comes to power after the upcoming Lok Sabha polls. He accused the BJP of attempting to topple the JMM-Congress-RJD government in Jharkhand due to the tribal chief minister.
On Tuesday, addressing a press meet in Gumla, Gandhi cited ongoing efforts in Telangana as an example. He underscored that wherever the Congress is in power, initiatives for caste enumeration are underway, signalling the party’s dedication to understanding and addressing the diverse social fabric of India.
Expanding on the party’s agenda, Gandhi outlined the party’s vision to extend reservation benefits to backward classes while safeguarding the reservation quotas allocated for Dalits and tribals.
He criticized Prime Minister Narendra Modi for his stance on caste issues and alleged attempts to suppress democracy in opposition-ruled states.

रांची- कांग्रेस नेता राहुल गांधी की पार्टी के सत्ता में आने पर सरना कोड को मान्यता देने की प्रतिज्ञा के जवाब में, पूर्व सांसद और आदिवासी सेंगेल अभियान के अध्यक्ष सालखन मुर्मू ने घोषणा के समर्थन में ठोस कार्रवाई की आवश्यकता पर जोर दिया। मुर्मू ने गांधी के बयान का स्वागत किया लेकिन जोर देकर कहा कि आदिवासी आबादी का विश्वास हासिल करने के लिए केवल घोषणाएं पर्याप्त नहीं हैं।
गौरतलब है कि राहुल गांधी ने सोमवार को भारत जोड़ो न्याय यात्रा के दौरान रांची में एक सार्वजनिक रैली को संबोधित किया था. गांधी ने झारखंड में हालिया राजनीतिक घटनाक्रम पर भाजपा सरकार की आलोचना की और आरोप लगाया कि पार्टी ने सरकार को गिराने की कोशिश की क्योंकि मुख्यमंत्री आदिवासी थे। उन्होंने कहा कि कांग्रेस सरना धर्म कोड की मान्यता का समर्थन करेगी और इसके लिए प्रयास करेगी.
द मूकनायक से बात करते हुए, सालखन मुर्मू ने इस बात पर जोर दिया कि कांग्रेस पार्टी को मौजूदा संसद सत्र में सरना कोड का मुद्दा उठाना चाहिए और सक्रिय कदम उठाना चाहिए, जैसे राष्ट्रपति को सरना पर एक ज्ञापन सौंपना और राहुल गांधी के नेतृत्व में एक राष्ट्रीय सार्वजनिक बैठक आयोजित करना। उन्होंने ऐतिहासिक संदर्भ पर प्रकाश डालते हुए बताया कि आदिवासियों के लिए अलग धर्म कोड को 1951 की जनगणना में कांग्रेस सरकार ने ही हटा दिया था.
वहीं, सेंगेल ने बीजेपी की केंद्र सरकार को 31 मार्च 2024 तक का अल्टीमेटम दिया है. अगर सरना धर्म कोड को मान्यता नहीं दी गई तो 7 अप्रैल 2024 को भारत बंद होगा और रेलवे और सड़क यातायात बाधित होगा. आदिवासी सेंगेल अभियान, अन्य आदिवासी संगठनों के साथ, तब तक आंदोलन जारी रखेगा जब तक प्रकृति पूजक आदिवासियों का सरना धर्म कोड हासिल नहीं हो जाता, ”उन्होंने आगे कहा।
भारत जोड़ो न्याय यात्रा के हिस्से के रूप में रांची में एक सार्वजनिक रैली के दौरान राहुल गांधी ने आगामी लोकसभा चुनावों के बाद विपक्ष का भारत गुट सत्ता में आने पर देश भर में जाति जनगणना कराने और आरक्षण पर 50 प्रतिशत की सीमा हटाने की कसम खाई। उन्होंने भाजपा पर आदिवासी मुख्यमंत्री के कारण झारखंड में झामुमो-कांग्रेस-राजद सरकार को गिराने का प्रयास करने का आरोप लगाया।
मंगलवार को गुमला में एक प्रेस वार्ता को संबोधित करते हुए गांधी ने उदाहरण के तौर पर तेलंगाना में चल रहे प्रयासों का हवाला दिया. उन्होंने रेखांकित किया कि जहां भी कांग्रेस सत्ता में है, वहां जाति गणना की पहल चल रही है, जो भारत के विविध सामाजिक ताने-बाने को समझने और संबोधित करने के लिए पार्टी के समर्पण का संकेत है।

Delhi Police Prevents DU Campus Protest, Dr. Ritu Singh and Supporters Detained

Ritu Singh and a few of the protestors were detained at Maurice Nagar Police Station while others were taken to Jaffarpur Kalan Police Station. Many were forcefully dispersed by the forces present near the campus.

New Delhi – As the turn from Vishwavidyalaya metro station towards Chhatra Marg was made to reach Dr. Ritu Singh’s protest site inside the Delhi University campus, an uncanny silence welcomed visitors. Absent were the usual sloganeering or chants of ‘Jai Bhim’, which used to be distinguishing features of the dismissed teacher’s demonstrations. Even before reaching gate no. 4 of Art’s Faculty where the demonstration was slated to start, multiple police personnel and police buses were detaining anyone who wanted to stand in solidarity with Dr. Ritu Singh.
Dr. Ritu Singh’s ongoing protest against alleged casteism, particularly against Principal Savita Roy of Daulat Ram College, took a concerning turn last month when the Delhi University authorities responded with controversial measures. The protest, which gained momentum amid violence and vandalism, confronted many challenges, including the locking of university gates, the purification of the protest site with Gangajal and detainments of activists and supporters.
On Tuesday, as The Mooknayak tried to approach the protest site, the team was stopped by a man in Khaki. “You cannot go any further,” he said. Being a media person held no value to him. “You either take a step back or join the detainees in one of the buses,” stated the policeman.
When asked why a journalist cannot take a few pictures to document the process, the scribe met with another stern warning. At 10:00 AM, Dr. Ritu Singh, Ashutosh Boddh, and other demonstrators attempted to approach the site by car via Vallabhbhai Patel Chest Institute, but they were stopped. Hundreds of protestors were detained.
Some were even dragged by their feet to be forcefully boarded onto buses. Through social media, it was later revealed that Dr. Ritu Singh too was detained. She was taken to Maurice Nagar police station. Police also detained ‘Bahujan poet’ Abhishek Kumar Jatav. In a warning tone Jatav said to the cops, “Don’t misbehave, time will change …”
Addressing citizens through X (formerly Twitter), Singh said, “We are not being taken inside the station nor are we being let go. Hundreds and thousands of police forces have cordoned off the north campus.” The dismissed teacher continued, “But the time for the Inqilab of Ambedkar and Ambedkarwad has come. This movement will not stop until the convict is arrested. The police have to arrest Principal Savita Roy of Daulat Ram College because that is how the rules and regulations of the constitution function.”
With an undeterred voice, Singh further remarked, “Ladenge Bhima Koregaon Ke Tarah, Padenge Bhim Rao Ke Tarah (We will fight like Bhima Koregaon and fall like Bhim Rao).” It was also revealed that some demonstrators were singled out and taken to Jaffarpur Kalan police station, which is far from Maurice Nagar police station where others are detained. There, they were made to stand in a line to be counted while being verbally abused. A fellow protestor who was able to save themselves from detainment later revealed the kind of fear they felt. They said, “It felt very dehumanizing. I do not think a protest where the majority is from the upper caste will face such abusive handling as Ritu Singh’s protests go through.” A local stall owner opened up about the police deployment on the site. He revealed to The Mooknayak, “the police have been here since the morning and have been picking demonstrators in batches.” He added, “the police say section 144 has been imposed here so they are not letting anyone stand here.”
“There was a violent attack yesterday, maybe a larger number of police have been deployed keeping the attack in mind,” added the stall owner. He was referring to the assault of Ashutosh Boddh, the president of Bhim Army Student Federation who used to stand along with the former ad-hoc professor during her protests. Taking to social media, Dr. Ritu Singh had alleged on 5th January that “RSS-affiliated goons attacked Ashutosh while claiming no number of protests could make any difference.” The same post alleged that the attack took place around 6:00 PM near gate no. 4 Arts Faculty where the goons threw boiling tea on the Dalit student leader. He has sustained multiple injuries and burns due to the abuse. A complaint has been filed at Maurice Nagar Police Station on Tuesday.

The Director of National Commission for Scheduled Castes, S. Ravivarman, on Tuesday said Adi-Dravidar residents of Vengaivayal, Dalit organisations and political parties wanted a Central Bureau of Investigation (CBI) probe into the case of mixing of faeces in the overhead water tank at the village that supplied drinking water to the Dalit families.

The incident was reported in December 2022 and is being probed by the Crime Branch CID for more than a year now after it was transferred to them from the Pudukottai District Police.
Mr. Ravivarman conducted an inquiry at Vengaivayal in connection with the case and spoke to the affected Adi Dravidar families. Mr. Ravivarman, who spent nearly an hour at the village, inspected the overhead water tank which had been shut and barricaded.
Later he told journalists that the Adi Dravidars felt the case was not proceeding in the right direction. They had given a complaint based on their suspicions after the incident but no action was taken on it. The incident took place following some problem between the panchayat president and the tank operator over sharing of water, according to the villagers.
Asked why it took more than a year for the Commission to visit Vengaivayal, Mr. Ravivarman said the Commission had been in touch with the Tamil Nadu government and was duly following it up with the Chief Secretary. The Commission had received a communication when the DNA tests, as part of the CB-CID probe, had begun. Since nothing fruitful emerged from the tests, the Commission’s Chairman had instructed him to visit the village, Mr. Ravivarman added.
Replying to another query, Mr. Ravivarman said the Adi Dravidars told him they had raised suspicions against some persons and inquiring them could have revealed the truth. Instead, they (Adi Dravidars) were being questioned repeatedly despite being the affected lot.
Mr. Ravivarman said he would submit his report to the Commission’s chairman and thereafter the latter has to decide on the plea for CBI probe and make recommendations.
Nonetheless, he said the CB-CID did not lack talent or skill and hoped the investigating agency would crack the case soon.

On Tuesday, the Constitution bench, also comprising justices BR Gavai, Vikram Nath, Bela M Trivedi, Pankaj Mithal, Manoj Misra and Satish Chandra Sharma, commenced the hearing on the permissibility of subclassification within the SC/ST reservation as it made some significant remarks on the purpose of reservation for marginalised groups and the requirement of maintaining efficiency in administration.
Article 335 of the Constitution states that the claims of the members of SC/ST groups shall be taken into consideration “consistently with the maintenance of efficiency of administration” in the making of appointments to services and posts under the Centre or states.
On the first day of hearing, Punjab’s advocate general Gurminder Singh and the state’s additional advocate general Shadan Farasat argued in favour of subclassification within SC/ST communities to provide preference in quota to Balmikis and Mazhabi Sikhs. Farasat referred to Article 335, contending it was not a limiting provision but an enhancing provision for reservation and also for sub-categorisation. “Efficiency is contextual,” he argued.
Responding, the bench said that efficiency is a concept depending on how it is defined. “Because the postulate of the Constitution is not that people who belong to the marginalised groups are inefficient and those who belong to other groups are efficient...and therefore, having more of the reserved categories will detract from efficiency. It’s to the contrary,” said the court.
“It’s consistent with the need to maintain efficiency in administration,” it added.
Shadan said diversity is essential for efficiency in administration, especially in government offices because public officers are expected to deal with diverse groups of people.
At one point of the day-long hearing, justice Nath asked Punjab’s advocate general whether the state was in favour of putting some of the subcastes within the SC/ST category outside the umbrella of reservation benefits if they have done consistently better and are on par with the unreserved categories. “So, they should come out of it and compete with the general. Why stay there? Those who are backward within the backward, let them have the reservation,” observed the judge.
Justice Gavai also stepped in to opine that within a particular backward class, when certain castes have reached a certain position and are on par with forward castes, they should move out.
“But then, that is only for Parliament to decide... now what happens, a person from SC/ST gets into IAS/IPS, etc. Once you are there, their children do not suffer the disadvantages that persons from the other SC communities suffer. But, by virtue of reservation, they are also entitled to the benefits for the second generation and again the third generation,” said justice Gavai.
Singh replied that though it is for the President to declare SC/ST groups under Article 341 and states cannot tinker with that list, he was in agreement with the proposition that the subgroups that have attained forwardness should exit and make rooms for those who really need quota benefits. Singh also pointed out that a five-judge bench in the Jarnail Singh case (2018) has made the creamy layer test applicable to reservation in promotions of SC/STs.
The court will continue hearing the case on Wednesday.
The matter was referred to the larger bench by a five-judge bench in 2020, observing that the judgment of another five-judge bench in EV Chinnaiah vs State of Andhra Pradesh (2005), which held that subclassification was not permissible, may require a reconsideration. This judgment held that scheduled castes form homogenous classes and there cannot be any subdivision.
The 2005 judgment by the apex court became the basis for the Punjab and Haryana high court to quash a 1975 notification of the Punjab Government, dividing its existing 25% reservation for SCs into two categories. Half of these seats were to be offered to Balmikis and Mazhabi Sikhs, while the rest were for the remaining groups within the SC category. This notification was nixed by the high court in 2006.
Later, the Punjab government passed the Punjab Scheduled Caste and Backward Classes (Reservation in Services) Act, 2006. It introduced “first preference” reservation for the Balmikis and Mazhabi Sikhs, laying down that 50% of reserved seats would be offered first to these two communities before all other SC groups. But in 2010, the high court struck down this provision of the Act based on the decision in EV Chinnaiah, leading to an appeal by the state government in the top court.
Finally, in 2020, a five-judge bench referred the matter to a larger bench, noting that the 2005 judgment by the coordinate bench requires to be revisited. While doing so, this bench said: “Reservation was not contemplated for all the time by the framers of the Constitution. On the one hand, there is no exclusion of those who have come up, on the other hand, if subclassification is denied, it would defeat the right to equality by treating unequal as equal.”
PM Modi-led panel clears names for Lokpal chief, vigilance commissioner
The Lokpal is currently headed by justice Pradip Kumar Mohanty, who is the acting chairperson. Of the two VC posts, one is vacant.
Supreme Court judge Ajay Manikrao Khanwilkar was elected as the new chairperson of Lokpal, and Aeratu S. Rajeev, managing director (MD) of Bank of Maharashtra, was picked for the post of Vigilance Commissioner (VC) by a committee led by Prime Minister Narendra Modi on Wednesday, officials aware of the details said.

Congress’s floor leader Adhir Ranjan Chowdhury, who is a member of the selection panel, gave a short dissent note on Rajeev’s selection, the officials said. Chowdhury had proposed the name of Atanu Das, former MD and chief executive officer (CEO) of Bank of India, for the post of VC.
The Congress leader did not oppose the name of Khanwilkar as his candidature was conveyed to him at the last moment, the officials added.

Khanwilkar was confirmed as a permanent judge in the Bombay high court in April 2002. He served briefly as the chief justice of Himachal Pradesh high court and was then appointed the chief justice of Madhya Pradesh high court in November 2013. He was elevated to the Supreme Court in May 2016 and served a six-year term until his retirement in July 2022.
Khanwilkar was a part of the majority of the five-judge bench that held that the right to die with dignity is a fundamental right under Article 21, in Common Cause v Union of India (2018), thereby, allowing a patient to refuse medical treatment,for illness.
