Andhra Pradesh tribal welfare assistant secretary (caste verification) Mary Ratnamani said the state government had asked the Centre to include three tribes, the Bondo Porja, Khond Porja and Konda Savara in the list.
She said these tribes would now be treated on par with other tribes in the scheduled list and would be entitled to benefits like reservation in education and employment as well as access to welfare schemes from the Integrated Tribal Development Authority (ITDA).

Decks cleared for ST status to Paharis, three other tribes as RS clears bill

Inclusion of Valmikis in SC category too approved

JAMMU, Feb 9: Decks were today cleared for grant of Scheduled Tribe (ST) status to Pahari Ethnic and three other tribes with Rajya Sabha giving nod to the bill moved by Tribal Affairs Minister Arjun Munda. The Upper House also approved two other bills pertaining to Jammu and Kashmir including grant of reservation to Other Backward Classes (OBCs) in Panchayats and Municipalities and inclusion of Valmikis in the SC list which were moved by Union Minister of State for Home Nityanand Rai and Social Justice and Empowerment Minister Dr Virendra Kumar respectively.
The bills were passed after nearly three hours long debate in which several Opposition members demanded conduct of Assembly elections and restoration of Statehood to Jammu and Kashmir. The BJP MPs, however, hailed abrogation of Articles 370 and 35-A by Narendra Modi Government leading to complete integration of J&K with rest of the country saying it was because of abrogation of special status that deprived people are getting their rights now.
After assent to be given by the President of India Droupadi Murmu to the bills, they will become laws and the reservations will come into effect.
One of the bills grants ST status to Pahari Ethnic Tribe, Paddari tribe, Koli and Gadda Brahmins which will enable them to reservations in Government jobs, educational institutions and political reservations. However, the Ministry of Home Affairs as well as UT Government have already made it clear that these tribes will be treated as separate group for reservations and the quota being enjoyed by existing tribes like Gujjars and Bakerwals will not be diluted at all.
Second bill extends reservations to OBCs in Panchayats and Municipalities in Jammu and Kashmir. The Government had delayed these two local elections which were scheduled to be held in October-November last year to grant reservations to the OBCs. The OBCs will also get reservations in the posts of District Development Council (DDC) and Block Development Council (BDC) chairpersons.
Third bill pertained to inclusion of Valmiki community as a synonym of Chura, Bhangi, and Mehtar communities in list of Scheduled Castes in J&K.
The Lok Sabha has already approved the Constitution (Jammu and Kashmir) Scheduled Tribes Order (Amendment) Bill, 2024, the Jammu and Kashmir Local Bodies Laws (Amendment) Bill, 2024 and the Constitution (Jammu and Kashmir) Scheduled Castes Order (Amendment) Bill, 2024, earlier this week.
The three bills were taken simultaneously for discussion and passage in the Upper House.
Replying to the discussion on the Constitution (Jammu and Kashmir) Scheduled Tribes Order (Amendment) Bill, 2024, which granted ST status to Pahari Ethnic Tribe, Paddari tribe, Koli and Gadda Brahmins, Union Minister for Tribal Affairs Arjun Munda said the bill seeks to give justice to the communities who were demanding ST status for long.
“The scrapping of Article 370 has allowed us to bring these laws,” he noted.
Replying to the Jammu and Kashmir Local Bodies laws (Amendment) Bill, 2024, Minister of State for Home Affairs Nityanand Rai said the Government has taken several steps for the welfare of the OBCs in the Union Territory and this amendment is another step in that direction.
There are three main amendments to the bill. Firstly, the bill ensures reservation for OBCs in Panchayats and Municipal bodies in Jammu and Kashmir. Secondly, the State Election Commission will be in-charge of conducting elections to Panchayats and Municipalities, he said.
Thirdly, the removal process of State Election Commissioner will be according to the Constitutional provisions and can only be removed under circumstances similar to those of a Judge of a High Court, Rai added.
He also listed out the development works undertaken after removal of Article 370 in the Union Territory and said Jammu & Kashmir is now peaceful and on the path of development.
Rai said incidents of terrorist activities and stone pelting have come down.
Replying to the discussion on the The Constitution (Scheduled Castes) Order (Amendment) Bill, 2024, Minister for Social Justice and Empowerment Dr Virendra Kumar said the communities will get the benefits of so many schemes with the passing of the bills.
“We do not do vote bank politics but try to strengthen the weaker section of the society,” he stated.
Participating in debate on three bills, a number of MPs from different Opposition parties demanded that Assembly elections should be held in Jammu and Kashmir and Statehood should be restored at the earliest.
Neeraj Dangi (Congress) said there was “bureaucratic rule” in Jammu and Kashmir and the Assembly elections should be held there at the earliest.
“If all is well in Jammu and Kashmir as stated by the Government, then why there is still violence in the Valley and citizens are not safe”? Dangi asked.
Aditya Prasad (BJP) said Jammu and Kashmir was deprived of development earlier. However, he added, following abrogation of Article 370 of the Constitution of India that granted special status to erstwhile State of Jammu and Kashmir, there has been massive development there.
Dr John Brittas (CPM) demanded restoration of Statehood not only in Jammu and Kashmir but in Ladakh also.
“Now, Ladakh has also been demanding Statehood. Their position was better with Jammu and Kashmir than now,” Brittas said.
Dr Sasmit Patra (BJD) said he and his party fully support the three bills.
“Jammu and Kashmir has witnessed lot of change and transformations. Good era has returned to Kashmir,” Patra added.
Dr Ashok Kumar Mittal (Aam Aadmi Party) said his party supports the bills which are aimed at giving rights to deprived sections of the society. He recalled that his party had supported abrogation of Article 370 of the Constitution of India and voted in favour of the bill then.
Dr Kalpana Saini (BJP) said the credit for complete integration of Jammu and Kashmir with rest of India goes to Prime Minister Narendra Modi and Home Minister Amit Shah who abrogated Articles 370 and 35-A.
R Girirajan (DMK) wanted to know how much Army and other defence personnel have been deployed in Jammu and Kashmir.
Rajmani Patel (Congress) said the Assembly elections should have been held in Jammu and Kashmir.
“The Government isn’t serious towards Other Backward Classes,” Patel said and demanded conduct of caste census.

संविधान (अनुसूचित जाति) आदेश (संशोधन) विधेयक, 2024 पर चर्चा का जवाब देते हुए सामाजिक न्याय और अधिकारिता मंत्री डॉ. वीरेंद्र कुमार ने कहा कि विधेयकों के पारित होने से समुदायों को कई योजनाओं का लाभ मिलेगा।
उन्होंने कहा, ''हम वोट बैंक की राजनीति नहीं करते बल्कि समाज के कमजोर वर्ग को मजबूत करने का प्रयास करते हैं।''
तीन विधेयकों पर बहस में भाग लेते हुए, विभिन्न विपक्षी दलों के कई सांसदों ने मांग की कि जम्मू-कश्मीर में विधानसभा चुनाव होने चाहिए और जल्द से जल्द राज्य का दर्जा बहाल किया जाना चाहिए।
नीरज डांगी (कांग्रेस) ने कहा कि जम्मू-कश्मीर में "नौकरशाही शासन" है और वहां जल्द से जल्द विधानसभा चुनाव होने चाहिए।
"यदि जम्मू-कश्मीर में सब कुछ ठीक है, जैसा कि सरकार ने कहा है, तो घाटी में अभी भी हिंसा क्यों है और नागरिक सुरक्षित नहीं हैं"? दांगी ने पूछा.

“जम्मू और कश्मीर में बहुत सारे परिवर्तन और परिवर्तन देखे गए हैं। पात्रा ने कहा, कश्मीर में अच्छा युग लौट आया है।
डॉ. अशोक कुमार मित्तल (आम आदमी पार्टी) ने कहा कि उनकी पार्टी उन विधेयकों का समर्थन करती है जिनका उद्देश्य समाज के वंचित वर्गों को अधिकार देना है। उन्होंने याद दिलाया कि उनकी पार्टी ने भारत के संविधान के अनुच्छेद 370 को निरस्त करने का समर्थन किया था और तब विधेयक के पक्ष में मतदान किया था।
डॉ. कल्पना सैनी (भाजपा) ने कहा कि जम्मू-कश्मीर के शेष भारत के साथ पूर्ण एकीकरण का श्रेय प्रधानमंत्री नरेंद्र मोदी और गृह मंत्री अमित शाह को जाता है, जिन्होंने अनुच्छेद 370 और 35-ए को निरस्त कर दिया।
आर गिरिराजन (द्रमुक) जानना चाहते थे कि जम्मू-कश्मीर में कितनी सेना और अन्य रक्षा कर्मियों को तैनात किया गया है।

Life imprisonment to the couple who murdered Dalit youth in Banda

The couple had killed a young man by stabbing him with a knife when he refused to bring them liquor. The judge found the accused couple guilty in the case and sentenced them to life imprisonment and a fine of Rs 81,000 each. The culprits are detained in Mandal jail since the incident.
Premchandra Kori, 22-year-old son of Rajendra Kori, resident of Jaurahi village of Dehat Kotwali area, was sitting outside the house at around 10 pm on August 20, 2023. Village resident Raju Aarch, son of Rajwa Aarch called him and asked him to bring liquor. When Premchand refused, Raju brought a knife from inside the house while abusing him. He started attacking Premchand’s neck with a knife. Raju’s wife Deepawali was holding Premchandra from behind.

Talking to IANS, Bengaluru Rural SP Mallikarjun Baladandin stated on Friday that the accused youth is not in a position to speak. He has been hospitalised and is under police surveillance. “Once he recovers we will be able to verify the allegations against him and ascertain the exact cause of the murder.”

After this we submitted an application to CP on which action has been taken.
Taking cognizance of the case of molestation and beating, Police Commissioner Varanasi has ordered the Baragaon police to register a case against the accused, in relation to which the local police has filed a case against the accused under sections of molestation, beating and SC-ST Act. The registered tax is investigating the matter.

General category Welfare Federation welcomes observation of Supreme Court on reservation quaota
CHANDIGARH: General Category Welfare Federation (PSPCL/PSTCL) welcomes the observation of the Supreme Court that the castes which have progressed by benefiting from reservation should compete with the general category, leaving the quota for those still lagging behind, said Jaswant Singh Dhaliwal, Chairman.
Kuljeet Singh Ratol President and Sukhpreet Singh General Secretary said that the observation of the apex court that amongst a particular category, some of the sub-castes have done better is absolutely right. They are the forward in that particular category and should come out of that and compete with the general category.
The Federation quoted the earlier decision of the Supreme Court of January 2022 that no yardstick can be laid down by this court for determining the adequacy of representation of SCs / STs in promotional posts for the purpose of providing reservation. It is for the State to assess the inadequacy of representation of SCs and STs in promotional posts, by taking into account relevant factors. The unit for operation of the rooster would be the cadre strength. The data collected to determine inadequacy of representation for the purpose of providing reservation in promotions needs to be reviewed periodically.
A seven-judge Constitution Bench led by CJI DY Chandrachud Supreme court is hearing arguments on the issue of sub-categorisation in Scheduled Castes and Scheduled Tribes for availing of quota benefits, and posed several thought-provoking questions on the contentious issue. It's for Parliament to take a call on the issue. Kuljit Singh President demanded that the Parliament should now take note of the Supreme Court's observation.
A person from a scheduled caste or scheduled tribe gets into IPS. So, once he’s an IPS, IFS, his children don’t suffer the disadvantages that the persons from category who are residing in the villages suffer. But then by virtue of reservation, they are also entitled to get reservation for the second generation and again the third generation.
V K Gupta Spokesperson stressed that SC/ST employees are working on more than their share quota posts and this needs to be set right by giving due representation to general category employees as per their share quota.
Violation of Reservation System — a New Normal in BJP-ruled States?

Lucknow: Prime Minister Narendra Modi plays the OBC card in election rallies and claims to be a champion of social justice. His occasional gestures of mingling with the people from the lower strata of the society have contributed to his popularity. However, when it comes to implementation of reservation, his party’s governments in states have allegedly been caught violating the norms of affirmative action.

However, alleged violation of the reservation system is quite rampant and often goes unnoticed. In the latest one such case, the Bihar Public Service Commission (BPSC) released a notification for 220 assistant professor positions without fixing any quota.
The BPSC Assistant Professor Recruitment 2024 has the details of departments with vacant seats, number of vacancies, educational qualifications required for the announced positions, pay grade, age limit and concession in age limit. What is missing in the notification is that it does not talk about the number of seats reserved for the candidates belonging to SC, ST and OBC communities.
Interestingly, the notification provides for concession in fees and age limit to the candidates from the SC/ST candidates on furnishing the caste certificate.
The Mooknayak spoke to Priyanka Bharti, national spokesperson of the Rashtriya Janata Party (RJD), the principal Opposition in the state, about the apparent anomaly in the advertisement.
She said the BPSC has issued notification for vacancies in the medical colleges, but the notification has no mention of the reservation of SC/ST/OBC candidates.
She said the BJP-led Centre is giving ‘Bharat Ratna’ to Karpoori Thakur on one hand, while on the other, they are blowing the dreams of the socialist icon to smithereens by stripping the deprived off their constitutional right of reservation.
“Jannayak Karpoori Thakur was the first one who implemented the Mungeri Lal Commission report in North India,” she recalled.
The Mungeri Lal Commission gave rise to what is now called the Karpoori Thakur formula for reservation, carving out a quota for the most backward communities.
Denying Quota — a New Normal?
This is not the first occasion when the SC/ST/OBCs are being deprived of reservation. In the neighbouring states of Uttar Pradesh, around 6,800 students belonging to the reserved categories have been demonstrating at the Kanshiram Eco Garden in Lucknow for more than 600 days against “flouting” of quota norms in the 69,000 teachers vacancy, the notification for which was issued in 2018.
Acknowledging the discrepancy, the government had issued a new list — which was scrapped by the court in 2023.
It continued unabated. In 2023, the Uttar Pradesh Subordinate Staff Selection Commission (UPSSSC) released notification for the post of the village development officer (VDO). Out of the total 1,468 vacancies, only 139 seats were reserved for OBCs, which account for 9.75% as against the 27% reservation the OBC category candidates are entitled to.
In July 2023, the UPSSSC did it again. Of the total 157 vacancies for the post of Eye Testing Officer, no seat was reserved for SCs, only two seats were reserved for STs, and 30 vacancies for OBCs as opposed to the mandated 34 for SCs, three for STs and 42 for OBCs because reservation for these three categories are 21%, 2% and 27%, respectively in state.
The brazenness of the commission continued this year as well. Of the total 1,002 vacancies of pharmacists (Ayurvedic medicines), only 126 seats were reserved for the OBC category as against 270. One interesting thing to be noted is that the vacancies for unreserved and EWS are in proportion to their reservation.
Samajwadi Party leader Swamy Prasad Maurya took to X to raise the issue, saying, “The reservation scam has again taken place in Ram Rajya. The BJP government is continuously attacking the reservation of SC/ST/OBC, and the SC/ST/OBC leaders belonging to BJP are acting like Dhritarashtra (who was blind).”
Many analysts believe that the BJP derives the impunity in gross violation of reservation norms by playing the religion card, which unites the Hindu community in the times of elections.
Underfunding of SC/ST Sub-plan in UP Budget Sparks Outcry

Lucknow- In a comprehensive analysis of the Uttar Pradesh budget for the fiscal year 2024-25, Dalit organizations including National Dalit Watch, National Campaign for Dalit Human Rights (NCDHR), UP, Bundelkhand Dalit Adhikar Manch, and Dalit Arthik Adhirkar Manch have highlighted significant gaps in the allocation of funds for the Scheduled Caste/Scheduled Tribe (SC/ST) Sub-plan.

Kuldeep pointed out that the total gap is 38, 672 crore as apart from the gap of 6,257 crore in the total scheme allocation, a further 32,415 crore has been diverted to non-targeted allocation.
There are two parts to the Sub-plan: one is targeted, and the other is non-targeted. The targeted part is rigorously implemented, but it constitutes a smaller portion than the non-targeted part, which is usually not implemented in a focused manner.
There are a total 121 Schemes, which are non-targeted and a diversion of Rs 4014.17 crore has been made, which does not beneftits the Dalits directly like the money allocated for the state/national highways, the money provided for the distribution network of UPPCL ( Uttar Pradesh Power Corporation Limited) . There are very few schemes which benefit the Dalits directly.
Consequently, Dalit bodies demand the enactment of a law for the SC/ST Sub-plan, akin to Karnataka, Telangana, and Andhra Pradesh, to prevent the diversion of funds to schemes unrelated to Dalit communities. Such legislation would ensure independent auditing and proper implementation of schemes, safeguarding Dalit youths' access to loans and scholarships.
Additional demands include the clawing back of funds directed to other schemes from the SC budget and the preparation of a separate budget addressing climate change and disaster management.
This would aid in the rehabilitation and relief work for Dalit communities affected by environmental crises.
