உங்களுக்கு பிரச்சினையா?


வாழ்க்கையின் பிரச்னைகள்– நூறு ஒட்டகங்களின்,பிரச்சினை.

இராஜஸ்தானில் உள்ள ஒரு மாவட்டத்தில், ஒரு மனிதர் வாழ்ந்து வந்தார். அவர் எப்போதுமே, ஒன்று அல்லது  இன்னொரு பிரச்சனையால் கஷ்டபட்டுக் கொண்டே இருந்தார்; அவர்  தனது வாழ்க்கையில் எப்போதும், மகிழ்ச்சி என்பதே இல்லாமல்  இருந்தார்.

துறவி ஒருவர், அவரது குழுவினரோடு, அந்த ஊருக்கு வந்து இருக்கிறார்  என்று அவர் கேள்விப் பட்டார்.  அந்த துறவியை போய் பார்க்க வேண்டும் என இவர் முடிவு செய்தார். மாலையில், இவர் துறவி தங்கி இருக்கின்ற, இடம் தேடிச் சென்றார். அங்கே சென்று, சற்று காத்திருந்த பிறகு, அவர், அந்த துறவியை சந்திக்கும் அனுமதி பெற்றார்.

இவர் கூறினார், “பாபா, நான் எனது வாழ்க்கையில், மிகவும் மகிழ்ச்சி இல்லாமல் இருந்து கொண்டு  இருக்கின்றேன். எல்லா நேரமும்,  நான் பிரச்னைகளால் சூழப்பட்டு இருக்கின்றேன் – அலுவலகத்தில் டென்சன் நிலைமை, உடல் நலத்தில் பிரச்னை, வீட்டில் பிரச்னைகள்!
தயவு செய்து எனக்கு ஒரு வழி கூறுங்கள்; அதாவது எனது எல்லா பிரச்சனைகளும், ஒரு முடிவுக்கு வந்திட வேண்டும்.  மேலும், அதன் மூலம், நான் ஒரு மகிழ்ச்சியான, அமைதியான வாழ்க்கையை வாழ்ந்திட முடியும்.”

அந்த துறவி புன்னகைத்தார்;  அவனிடம் சொன்னார், “மகனே நான், நாளை காலையில்,  உனக்கு ஒரு தீர்வு கொடுக்கின்றேன்.    ஆனால், அதற்கு இடையில், நீ எனக்காக, ஒரு சிறிய வேலை செய்து தர முடியுமா?”. அந்த மனிதன் சம்மதித்தான்.

அந்த துறவி தொடர்ந்தார்,“ எங்கள் குழுவில், அங்கே நூறு ஒட்டகங்கள் இருக்கின்றன. இன்றைக்கு இரவு, நீ அந்த ஒட்டகங்களை நல்ல முறையில், கவனித்துக் கொள்ள வேண்டும் என்று நான் விரும்புகிறேன்.    அந்த நூறு ஒட்டகங்களும் கீழே அமர்ந்து கொண்டு விட்ட பிறகு, நீயும், அந்த இரவில்,  தூங்குவதற்குச் செல்ல முடியும்.   இதைக் கூறிக் கொண்டே, அந்த துறவி, தனது தங்கும், இடத்திற்கு சென்றார். அந்த இரவுப் பொழுதில், அந்த ஒட்டகங்களைக் கவனித்துக் கொள்வதற்காக,  அந்த மனிதன் சென்றான்.

அடுத்த நாள் காலை, அந்த துறவி அந்த மனிதரிடம் போனார். அவனிடம் கேட்டார்,”மகனே,  கழிந்த இரவு, நீ நன்றாக தூங்கினாயா? “
அந்த மனிதன், மிகவும் வருத்தம் அடைந்து, பதில் கூறினான். “பாபா, நான் ஒரு கணப் பொழுது கூட தூங்க முடிய வில்லை. நான் எவ்வளவோ முயற்சிகள் செய்த பிறகும் கூட, என்னால்,  எல்லா ஒட்டகங்களையும், ஒரே நேரத்தில், ஒன்று சேர்த்து, உட்காரச் செய்திட முடியவில்லை. சில, அவைகளாகவே உட்கார்ந்து கொண்டன; ஆனால் இன்னும் சில, நான் எவ்வளவோ, வெகு நேரமாக, நீண்ட முயற்சி செய்த பிறகும் கூட, உட்கார வைக்கப்பட முடியவே இல்லை. மேலும், ஒரு ஓரத்தில் ஒரு ஒட்டகம் அமர்கின்ற அதே வேளையில், இன்னொரு பக்கத்தில், இன்னொரு ஒட்டகம் தாமே, எழுந்து நின்று விடுகின்றது.“

அந்த துறவி புன்னகைத்தார்; அவரே சொன்னார்,“ நான் கூறுவது தவறாக இல்லை என்றால், நேற்று நடந்தது, இதுவாகத்தான் இருக்கும்.“

1. நிறைய எண்ணிக்கையிலான ஒட்டகங்கள், இரவு நேரத்தில், தாமாகவே, கீழே உட்கார்ந்து இருக்கும்.

2. இன்னும், பல் வேறு ஒட்டகங்கள், உங்களுடைய முயற்சியால், கீழே உட்கார்ந்து இருக்கும்.

3. மற்றவை,  நீங்கள் அவை அமர்வதற்காக முயற்சி செய்த பிறகும் கூட, அவை உட்காரவே இல்லை. பிறகு, நீங்கள் பார்த்திருப்பீர்கள்;   அதாவது, அவற்றில் சில,  நேரத்தின் ஓட்டத்தில், தாமாகவே உட்கார்ந்து கொண்டிருக்கும்.” 

அந்த மனிதன் பதிலளித்தான்,“ ஆமாம்! இதுதான், சரியாக நடந்தது ஆகும்!”

அந்த துறவி தொடர்ந்தார், “இப்போது, நீங்கள் கொஞ்சம் புரிந்து கொண்டு இருப்பீர்கள்? நமது வாழ்க்கையில் இருக்கும் பிரச்சனைகளும்,  இவை போன்றவைகளே என்பதைப் புரிந்து இருப்பீர்கள்.

1. சில தாமாகவே தீர்க்கப்பட்டு விடும்.

2. சில உங்களது முயற்சிகளால் தீர்க்கப்படும்.

3. சில, முயற்சிகள் செய்த பிறகும் கூட, தீர்க்கப்பட முடியாதவைகளாகவே இருக்கும். அவற்றை, காலத்தின் ஓட்டத்தில் தீர்க்கப்படுவதற்காக விட்டு விட வேண்டும். அவை சரியான நேரத்தில், அவைகளாகவே தீர்க்கப்பட்டு விடும். 

நேற்று இரவு நீங்கள், அனுபவப்பட்டு விட்டீர்கள். அதாவது
பரவாயில்லை.    நீங்கள் எவ்வளவோ முயற்சி செய்தீர்கள்; இருந்தாலும், உங்களால், எல்லா ஒட்டகங்களையும் ஒரே நேரத்தில் உட்காரச் செய்திட முடியவில்லை. நீங்கள் ஒரே ஒரு ஒட்டகத்தை, அமரச் செய்தால், பிறகு, இன்னொரு ஒட்டகம், அந்த பக்கத்தில், எழுந்து நின்று கொண்டு விடுகிறது. 

இதே வழியில், நீங்கள் ஒரு பிரச்னையை, தீர்க்கச் செய்தால்,  இன்னொரு பிரச்னை, வேறு எங்காவது வெளிப்பட்டுக் கொண்டு இருக்கிறது என்பதை, நீங்கள் பார்க்க முடியும். இதுதான் வாழ்க்கை! பிரச்னைகள் வாழ்க்கையின் ஒரு பகுதியே! சில சமயங்களில்  அவை குறைவாகவும், இன்னும் சில சமயங்களில், அவை அங்கே, அதிக அளவிலும், என்று இருந்து கொண்டு இருக்கும்.

மகிழ்ச்சியான தன்மையும், துன்பமும் வெறுமனே,  குழப்பமானவையே. பிரச்னைகள் வாழ்க்கையோடு ஒரு பகுதியாக இருப்பவையே.   இதைப் பற்றி நீங்கள் தொடர்ந்து நினைத்துக் கொண்டே இருக்கக் கூடாது.    அவற்றை ஒரு பக்கமாக தள்ளி வைத்து விட்டு, தொடர்ந்து முன்னேறிச் செல்லுங்கள்; வாழ்க்கையின்  அந்த குறிக்கோளை நோக்கி, சுயத்தை உணர்த நோக்கி வளர்வதற்குக் கற்றுக் கொள்ளுங்கள்.

“எப்போதுமே சிறந்த நேரமாக மட்டுமே, இருந்தாக வேண்டும் என்று  இருக்கின்றோம் என்றால், நம்மால் ஒரு போதும் மகிழ்ச்சியாக இருக்க முடியாது. நாம் ஏற்றுக் கொள்ள முயற்சி செய்கின்றோம் என்றால், நாம் இந்த உலகத்தோடு மட்டும் அமைதி ஏற்படுத்திக் கொள்வது என்று இல்லை, இன்னும் அத்துடன், நம்முடனும் நாமே, அமைதி ஏற்படச் செய்கின்றோம். அதன் பிறகு, நாம் நமது வாழ்க்கையில் நிபுணத்துவம் அடைவது என்பதை சாதிக்கின்றோம்.”

Two men were arrested by the police here on late Thursday for allegedly posting provocative social media posts that could potentially incite violence between two communities.Police sources said, R. Muthukumar, 29, and S. Akash, 19, were arrested by the Town Police here for their social media posts that boasts caste pride and promotes enmity towards another community in the wake of the recent murder of a youth L. Ajith Kumar in Mayiladuthurai. Both the arrested persons were lodged at the Sub Jail here after being produced before the Judicial Magistrate.

Courts have the duty to ensure that the law remains relevant amid shifting societal norms, Supreme Court Judge Justice B R Gavai said while underscoring the transformative value of the Indian Constitution.

“…When faced with multiple interpretations, the court opts for the one that best advances the constitutional values. Central to this transformative ethos is the role of the Supreme Court, which has to act as the custodian of the Constitution and the ultimate arbiter of justice,” Justice Gavai said in an address at the Columbia Law School on March 26.

Speaking on “75 Years of Transformative Constitutionalism”, he delved on how the Constitution reflects the transformative intent, the legislature’s commitment to uphold this through some of its enactments and on how the SC upheld the ethos of transformative constitutionalism through its interventions.

He said, “The transformational value of the Constitution is neither limited to ending colonial oppression nor is it concluded with specific socio-economic objectives. Instead, it is a perpetual ideal, a mindset that fosters an environment where dialogue and debate thrive, novel ways of existence are continuously explored and forged, embraced and challenged, and where change remains unpredictable, yet the concept of change persists.”

Pointing out that the “Constitution is mounted on the ideals of equality, liberty and fraternity that reinforce the ideals of social democracy and tend to transform society for the better”, he said that its framers “gave the most importance to the provisions of equality”. Justice Gavai said, “The transformative potential of the Constitution is more prominent in the accreditation of social and economic rights, which are enshrined in Part IV of the Constitution, as the directive principles for the state policy”.

He also referred to laws such as The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, The Prohibition of Employment as Manual Scavengers and their Rehabilitation Act, 2013, The Transgender Persons (Protection of Rights) Act, 2019, The Child Labour (Prohibition and Regulation) Act, 1986, The Prohibition of Child Marriage Act 2006, The Right of Children to Free and Compulsory Education Act, 2009, The Rights of Persons with Disabilities Act, 2016, The Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 among others as proof of the legislative intent to uphold the transformative intent of the Constitution.

Touching on the role of the Supreme Court in advancing transformative constitutionalism, Justice Gavai explained how it had broadened the scope of the fundamental rights chapter of the Constitution and affirmed privacy as a fundamental right. He also cited the rulings allowing women permanent commission in the armed forces, ensuring their reproductive choices and affirming the constitutionality of reservation policies as testimony of the court’s role.

He said “the intervention of the Supreme Court in educational access and equity has had far-reaching implications for India’s quest for universal education”.

Justice Gavai underlined that the Constitution “is evidence of the transformation of the governance structure in India from colonialism to democracy” and from the “order of the Queen” to the “will of the people”.

He said that “while democracy needs to be protected and upheld at all times by the people, the courts play a seminal role in reinforcing the supremacy of the Constitution and determining the validity of legislative and executive actions on the touchstone of the principles of the Constitution. The principles of democracy and judicial review are intertwined and complementary. These form the core of the basic structure of the Constitution”.

He also said that the SC had “underscored the necessity of the compliance of the electoral process with the principles of the Constitution and the laws for the success of democracy” and that “in doing so, it has repeatedly stressed on free and fair participation of voters in the electoral process”.

Referring to the recent judgement of an SC Constitution bench also comprising him in the electoral bonds case, Justice Gavai said that disclosure of information on the bonds to the voter cannot be restricted on the grounds of the informational privacy of the financial contributions to political parties.

“The expansion of the freedom to speech and expression under Article 19(1)(a) to include the right to information is a crucial recognition for the citizenry to effectively participate in the elections, which, in turn, is an intrinsic feature of democracy,” he said.

‘Criticism fine, false perception not’

New Delhi: Justice B R Gavai on Thursday highlighted the issue of a clip of the court’s proceedings being allegedly doctored to show CJI D Y Chandrachud in poor light. Attending a discussion hosted by the New York City Bar Association, he said that fair criticism of judgments is fine but there was unwarranted criticism of judges through doctored clips. He shared how a doctored clip of the CJI adjusting his chair was spread to create a false perception that he left the court in the middle of a hearing.

He recalled that when he was appointed as a judge in the Bombay High Court in 2003, he was a leading lawyer, and that there was no judge from Dalit/Scheduled Caste community in the HC. “That may be one of the factors in my appointment as a HC judge,” he said. He further said his appointment to the SC in 2019 was made solely on the account of giving representation to the SCs. “If not for giving representation to SCs, I would have been elevated maybe two years later,” he said. —ENS

Himachal scholarship scam: CBI files chargesheet against 20 institutes, 105 individuals

The Central Bureau of Investigation (CBI) has filed chargesheets against 20 institutions and 105 persons, including several officials allegedly involved in a multi-crore scam in the grant of scholarships to Scheduled Caste (SC), Scheduled Tribe (ST) and Other Backward Class (OBC) category students of Himachal Pradesh, reported ANI.

This information was shared by the central probe agency today, Friday, March 29. It also said that it has concluded investigations in the case.

"CBI has filed chargesheets against 20 Institutions and 105 persons including owners of said institutions, personnel of Directorate of Higher Education, Shimla, bank officials and other private persons," the CBI said.

During the investigation into the case, as many as 19 persons including employees of the Directorate of Higher Education, Shimla, chairman, vice chairman, directors and employees of educational institutes and bank officials were arrested.

About the case

The case was registered by CBI in the year 2019 on the request of the Himachal Pradesh government, against private educational institutions in the state for fake and fraudulent claims of scholarships of Rs 181 crore (approximately) during the year 2013 to 2017.

Thereafter, the High Court of Himachal Pradesh also monitored the investigation of the instant case and accordingly status reports were filed periodically.

The case pertains to the alleged misuse of the scheme of scholarship and reimbursement of fees launched by the Central government, implemented through the state governments to help the students of SC, ST and OBC categories.

The scam was unearthed following reports that the students of government schools in tribal Spiti valley in Himachal's Lahaul and Spiti district had not been paid the scholarship for the last five years, ANI added.

The ED had initiated a money laundering investigation on the basis of an FIR registered by the CBI under sections 409 (criminal breach of trust), 419 (cheating by personation), 465 (forgery), 466 (forgery in electronic documents) and 471 (using forged document as genuine) of IPC on May 8, 2019.




YSRC Leader Cites Naidu’s “Arrogance” Towards Dalits

Vijayawada: Bapatla MP, Nandigam Suresh, has said Telugu Desam chief Nara Chandrababu Naidu once again revealed his hatred towards the Dalits.

Addressing the media here on Friday, the MP showed a video in which Chandrababu was making fun of the YSR Congress over its allotment of ticket to a tipper/lorry driver for the Singanamala assembly seat in the present elections Suresh alleged that Naidu was habituated to insulting the Dalits.

Earlier, on one occasion, “Naidu severely insulted SCs by posing a question, ‘Who wants to be born as a Dalit’. Now, he mockingly talked about an SC leader by citing his profession of a tipper driver.

This is strong proof that Chandrababu is a man of low culture,” the MP stated. He said, “Chandrababu’s clan madness continues. Caste madness is embedded in his blood.”

The MP said Jagan Mohan Reddy aimed for the development of all classes of the society and hence offered the MLA ticket to tipper driver Veeranjaneyulu. Sadly Chandrababu has no respect for that Dalit. He asked Naidu, “Why are you so upset if political positions are given to Dalits? Why do you look down on drivers?”

Suresh pointed out that lakhs of people worked as auto or tipper drivers in AP. “We will surely answer his arrogance in future. We are saying that Chandrababu’s permanent political grave will be assured in this election. I request the Dalit leaders in TD to realize Naidu’s arrogant attitude and teach him a befitting lesson,” Suresh added.

Lucknow (Uttar Pradesh) [India], March 29: Escapades for the Soul were recently invited as mentors at a seminar conducted by the National Dalit Movement for Justice -NDMJ (NCDHR) for National Level Training of Human Rights Defenders on Promotion and Protection of Dalit Child Rights. There were 15-20 children and 50-60 activists who worked for Dalit child rights. These children and activists are leaders who sensitize and bring awareness to their villages, workplaces, hometowns, etc. This is the first time they have had a workshop on mental and emotional health.

Our topic for the seminar was Empowerment through Mindfulness, where the participants were made aware of what mindfulness is, why is it so important, and how impactful it is for each individual through activities and effective audiovisuals, as we believe that mindfulness is best understood and learned through experiential technique. We made it easy to grasp through relatable examples. Through our program, the participants learned simple mindfulness techniques that they could practice on a daily basis.

The reinforcement assignments, which are introspective yet simple, were provided to the participants in Hindi as well as English. “As human rights defenders, we are also under a lot of stress because when we hear the painful stories of the people, it impacts us negatively. So it is very important to practice mindfulness techniques to relieve stress,” says Rahul Singh, Head of CDMJ.

“We believe self-reflection and introspection are extremely important for personal development and growth in life. It also helps to develop a mindful approach to every aspect of their lives,” shares Nabarun. The Empowerment through Mindfulness workshop aimed at providing a couple of compact, practically viable mindfulness practices that would help the participants work on their stress, emotional well-being, focus, goal setting, and manifesting them through positive thoughts and consistent actions.

Power of thought and mindful communication were important segments of the program. Regular practice of mindfulness would help develop faith in an individual’s potential, break limiting beliefs, and gain confidence to dream big, which would improve their self-esteem. Building emotional resilience and dismantling negative thoughts were other extremely important segments of the workshop, which help individuals bounce back from setbacks and create a positive mindset for the future. The impact of the above would be responsible social behavior, a better response in challenging situations, and a compassionate approach towards others as leaders.

“It was satisfying and fulfilling to see the interactions of the participants, including the children. Their interest and understanding of the need for mindfulness-based practices give us encouragement to work further with such organizations, says Debika Mitra.
