The bench of Justice Sachin Shankar Magadum considered whether the Karnataka State Commission For Scheduled Caste And Scheduled Tribes had jurisdiction to recommend and issue directions to the State Bank of India to employ respondent, Chetana Sadashiva Kambale Sevanagara on compassionate grounds. The court observed: "The Apex Court and this Court in catena of judgments have consistently held that the Commissions for Scheduled Castes and Scheduled Tribes have no jurisdiction to issue directions relating to service matters." The Writ Petition was filed by the State Bank of India under Articles 226 and 227 of the Constitution of India praying to issue a Writ in the Nature of Certiorari to quash the order issued by the Commission and to grant an interim order to stay its operation. Congress president Mallikarjun Kharge on Thursday said that he skipped the consecration ceremony at the Ram Temple in Ayodhya since people from the Scheduled Caste and Scheduled Tribe communities continue to face discrimination over entry into temples across India. “If I go, would they have tolerated it?” Kharge asked.
“Congress guarantees to revive the Scheduled Caste Plan and the Tribal Sub-Plan and implement it by law,” he added.
