Nawada Dalit Basti Fire: Whatever happened in Nawada, Bihar on Wednesday was horrific. There should be no place for such incidents in a civilized society, but Bihar has a long history of such incidents. Whether it is the Belchi incident of the 70s or the Laxmanpur Bathe, Shankar Bigha, Senari, Mianpur and Bathani Tola as well as the Narkatiya Don incident of the 90s, humanity trembles at such ignorant stories. The recurrence of this bestial tendency of showing off or looking down upon each other has once again pushed Bihar back to the Middle Ages. While the world is taking pride in developing 5G technology and AI, there are still many places on the world map where tribal culture dominates. Well, be happy, there has been no news of anyone losing their life in the Nawada incident so far, otherwise another massacre would have been recorded in the official records of Bihar, which is full of a history of massacres. The surprising thing is that the government machinery did not have even the slightest inkling of this horrific incident. Come, let us complete the formality of remembering some of the incidents that took Bihar to the abyss on the pretext of the Nawada incident.

One of the biggest massacres in Bihar, the Laxmanpur Bathe massacre, took place on the night of 30 November and 1 December 1997, and 58 people were killed mercilessly in it. This massacre left many orphaned and in many families there was no woman left to take care of the household. In many families only children were left. On 7 April 2010, the lower court awarded death penalty to 16 accused and life imprisonment to 10 but on 9 October 2013, Patna High Court acquitted all the accused due to lack of evidence.

Shankar Bigha incident

This incident took place on the night of 25 January 1999 in Jehanabad district, in which 22 Dalits were killed. 16 years later on 13 January 2015, the district court honourably acquitted all 24 accused due to lack of evidence. This was perhaps the first case of massacres in which all the accused were acquitted by the lower court itself. It is said that all the witnesses of this case had turned hostile in the court and on this basis the accused were acquitted.

Bathani Tola and Bara massacre

In 1996, 22 people were killed in Bathani Tola village of Bhojpur district. This massacre was a revenge of the Bara massacre in Gaya district, in which 35 people were killed by slitting their throats on 12 February 1992. The verdict in this case also came in 2012, in which 3 culprits were sentenced to death and 20 were sentenced to life imprisonment.

Mianpur incident

Mianpur falls in Aurangabad district. Here 35 Dalits were killed on 16 June 2000. Due to lack of evidence, Patna High Court acquitted 9 out of 10 accused in July 2013, while the lower court had sentenced all these accused to life imprisonment.

Belchi massacre

The Belchi massacre should probably be mentioned at the top of the list of massacres that took place in Bihar in independent India, because it happened when the country had just 30 years of independence. In 1977, some people from backward castes killed 14 Dalits in Belchi village of Patna district. This massacre is not mentioned because of the loss of lives, but because after the massacre, the then former Prime Minister Indira Gandhi went there riding an elephant and after this she again managed to make a place in the hearts of the people in the Hindi belt.

Narkatiya Don massacre

On December 14, 1994, a massacre also took place in Ramnagar block of West Champaran district of Bihar, which is not discussed much. Perhaps it is not because the people who became victims of this massacre were not that important in terms of vote bank. Actually, they belonged to the Tharu tribe. On December 14, 1994, about a dozen people were killed in Bahuarwa village of Ramnagar block. Those killed included Gaurishankar Mahato, Ramvilas Mahato, Jairam Mahato, Vishran Mahato, Bhikhari Mahato, Dharmaraj Mahato, Chhedi Mahato, Roshan Mahato, Rogahi Mahato, Narsingh Mahato, Bhuvaneshwar Mahato, Rudal Mahato, Baliram Mahato, Sadakat Mian and Pandu Munda.

Nawada Fire: 15 Held For Torching 21 Houses, Says Bihar Govt; Rahul, Kharge Turns Heat On NDA For ‘Dalit Neglect’

Nawada: A day after 21 houses were set on fire in Bihar’s Nawada district, a top state government official on Thursday said 15 people have been arrested in this connection.

Preliminary investigations indicate that a land dispute may have triggered the incident, which took place in Manjhi Tola within Mufassil police station area on Wednesday evening, police said.

“The district police has arrested 15 people for allegedly torching the houses. A Special Investigation Team (SIT) has been formed to investigate further, and searches are ongoing to apprehend the remaining suspects, ” Nawada District Magistrate Ashutosh Kumar Verma said.

Verma said approximately 21 houses, some of which were semi-pucca, were burnt by a group in Manjhi Tola. He added that senior administrative and police officials on-site will provide a report detailing the exact number of damaged houses.

“We are providing relief materials, including food packets and drinking water, to those displaced. Temporary tents have been set up for the victims,” he noted. The DM refuted claims that cattle were charred, saying, “No evidence has been found to support that.”

Following the incident, Nawada SP Abhinav Dhiman told reporters, “A call was received around 7 PM regarding the fire in Manjhi Tola. Police arrived promptly with fire engines and extinguished the blaze.”

He confirmed that initial investigations suggest a land dispute as the motive and that a case has been registered. Another police officer claimed that shots were fired in the air during the arson.

Opposition parties have also blamed the government for ‘failing’ to curb the rise in crimes against marginalised communities across the country.

Cong slams NDA’s ‘double-engine’ govt for Dalit neglect

Congress President Mallikarjun Kharge on Thursday condemned the NDA’s double-engine government for its ‘failure’ to prevent a violent incident in Bihar’s Nawada district and ‘indifference’ towards Dalits. His remarks come a day after more than 25 homes in the Dalits’ settlement in Nawada were set ablaze by miscreants over a property dispute.

“The terror inflicted on the Mahadalit colony in Nawada, Bihar, is yet another example of the jungle raj under the NDA double-engine government,” Kharge stated in a post on X.

Kharge expressed his outrage over the attack, saying, “It is condemnable that around 100 Dalit houses were set on fire, there was firing, and everything the poor families had was stolen in the dead of night.”He criticised both the BJP and JD-U, accusing the double-engine government of “neglecting” its duty to maintain law and order in Bihar.”

“The BJP and its allies’ complete disregard for the Dalits and the underprivileged, their criminal neglect, and their encouragement of anti-social elements have reached its peak. Prime Minister Modi remains silent as usual, Nitish Kumar is not bothered by his greed for power and the NDA allies are speechless,” Kharge added.

Rahul Gandhi also blamed the BJP-led NDA for the incident.

“Burning down an entire colony of Mahadalits in Nawada and destroying the houses of more than 80 families is highlighting the horrifying picture of injustice against the Bahujans in Bihar. The cries of the Dalit families who had lost their homes and property and the terror created in the deprived society by the echo of the fierce firing were also not successful in waking up the sleeping government of Bihar. Such anarchist elements find shelter under the leadership of the BJP and its NDA allies – they intimidate and suppress the Bahujans of India so that they cannot even demand their social and constitutional rights. And, the silence of the Prime Minister is a seal of approval on this big conspiracy. The Bihar Government and the State Police must take immediate and strict action against all the culprits of this shameful crime and provide complete justice to the victim families by rehabilitating them,” Gandhi wrote on X.

Mayawati demands legal action by govt, aid to victims

BSP president Mayawati on Thursday demanded strict action by the Bihar government over burning down of several houses of Dalits in Nawada. The former Uttar Pradesh chief minister also called for full financial support by the government for rehabilitation of the poor victims.

“The incident of burning down of many houses of poor Dalits in Bihar’s Nawada by the goons and ruining their lives is extremely sad and serious. The government should take strict legal action against the culprits and also provide full financial help for the rehabilitation of the victims,” Mayawati posted in Hindi on X.

On Wednesday evening, 21 houses were set on fire by a group of people in Manjhi Tola under the Mufassil police station area of Nawada district in Bihar, according to local police.

No individual was hurt in the episode even though the police said preliminary investigation suggested that a land dispute could be the cause behind the incident.

Officials said the police had registered a case and launched an investigation into the matter, detaining 10 suspects by Wednesday night while a large contingent of the police was deployed in the area to prevent any flare-up.

Children playing outside a temple in Mainpuri, UP were brutally beaten up for allegedly desecrating the temple. Photos of injuries on the children’s bodies went viral on social media.

Uttar Pradesh. A case of brutal beating of Dalit children playing outside a temple in Mainpuri district has come to light. It is alleged that Dalit children playing outside the temple were beaten up citing the desecration of the temple. The incident is said to be from Daudapur village of Bewar police station.

According to the police, the incident is old. An FIR was registered in the case on August 26, but no accused was arrested.

Posting the photo of the incident on social media, Nagina Lok Sabha MP and Azad Samaj Party (Kanshi Ram) national president Chandrashekhar Azad wrote, “In the so-called Ram Rajya of Uttar Pradesh, the temple of the ‘feudal lords’ was desecrated by three Dalit children playing outside the temple. Angered by this, two religious contractors not only held the three children hostage and beat them, but also abused the elderly and women of the house with caste-specific abuses.” He further wrote, “Look at the condition of the casteist system, an FIR was registered on August 26 for the incident, but the police have not yet dared to arrest the accused feudal lords. The victim Sunny Pratap Jatav says that there is an atmosphere of fear in the family due to the non-arrest of the accused, the local BJP MLA and people from the ruling party are pressurizing for a compromise. @myogiadityanath ji, the lack of action in such incidents clearly smacks of casteism.” MP Chandrashekhar Azad warned that, “If the named accused are not arrested soon, then the workers of Azad Samaj Party will be forced to take to the streets.”

While, on the incident, Mainpuri Police informed through its official X handle that, “In this case, a case has already been registered against 02 named accused under relevant sections at the local police station, in which evidence collection and investigative action is in process, further legal action is being taken after investigation, other allegations of intimidation are baseless.”

Agartala: Tripura Pradesh Congress Committee (TPCC) on Wednesday lodged complaints at multiple police stations against three BJP leaders and a Shiv Sena MLA for issuing an open threat to Congress leader and LoP Rahul Gandhi.

The accused include Union minister Ravneet Singh Bittu, Shiv Sena MLA Sanjay Gaikwad, UP minister Raghuraj Singh and ex-BJP MLA of Delhi Tarvinder Singh Marwah.

Congress workers also staged demonstrations at several places and burnt the effigies of the four leaders demanding that police register FIRs against them, reports Biswendu Bhattacharjee.

Can creamy layer in the Dalit quota be justified?

Any change in policy which involves a question of life and death for Scheduled Castes should be determined by hard facts and not by unfounded assumptions.

The Supreme Court last month upheld sub-classification in the quota for Scheduled Castes (SCs) and Scheduled Tribes (STs). However, some judges further recommended adding creamy layer exclusions, restricting reservations to only one generation or once, making it time-bound, and adding economic criteria. The government has said that it will not implement the creamy layer exclusion. But clearly, these suggestions amount to a full-fledged assault on the concept of untouchability-based reservation. An assessment of the assumptions behind the suggestions is needed.

Let’s look at the arguments. Justice BR Gavai argued “unequal treatment to unequal classes” is justified if few members are far too advanced and added that only this can achieve real equality as enshrined under the Constitution. Justice Pankaj Mithal said, “The better of the class amongst the backwards eats up most of the vacancies/seats reserved leaving the most backward with nothing in their hands.” Are these statements based on real data?

Official data shows SC reservation benefits the economically weak and less educated people. This can be measured by two criteria — share in jobs and level of education. In 2022, about 89% of SC employees in the central government were in the C and D categories of jobs, and only 11% in A and B. In the same year, about 68% SC employees held degrees below secondary and higher secondary levels. More direct evidence came from the National Sample Survey on Employment 2022-23. About 78% of government employees were from lower income groups and 22% from top income households. The share of lowest, middle and highest income households was 41.4%, 36.5% and 22%, respectively. The share of these SC employees with education below secondary or higher secondary levels is 60%.

Clearly, there are substantial benefits of reservation to economically weaker SCs, though their representation is confined to low-level jobs. Hence, the view that better-off Dalits eat up more seats or vacancies is misleading. A second suggestion was about using economic criteria as the rationale behind reservation. This view holds that better economic standing is good enough for discrimination-free mobility. But this is not justified either by theory or empirical facts. The theory of economic discrimination tells us that group discrimination is based on group identity, such as race, colour, religion, ethnicity, caste or gender. In identity-based exclusion, such as untouchability, the untouchable group as a whole faces discrimination, irrespective of the economic status of an individual.

Empirical evidence also supports this assumption. A study by ActionAid in 2000 on social and economic discrimination in 11 states and another 2013 study of government institutions in eight states revealed discrimination in access to public amenities, in employment, in purchase of inputs and sale of output by farmers, and in purchases from SC-owned businesses in the transport, eateries and grocery sector.Another study of 90 SC businesses by scholar Asim Prakash revealed discrimination, Vinod Mishra’s study revealed discrimination against SCs in renting of houses in urban areas. In urban areas, higher-ranked officers faced more discrimination in the private sector. Internal surveys in IIT Bombay revealed caste humiliation of SC students. Thus, caste discrimination is a ubiquitous phenomenon experienced by Dalit individuals irrespective of their economic background, with some variations. The studies also showed that many SC students, government employees, and entrepreneurs who faced discrimination were second-generation beneficiaries of reservation. The view that limiting reservations to one generation will make SCs free of bias is unfounded.

Similar is the argument on the time limit of reservation. If untouchability persists 70 years after abolishing it and the gap between SCs and the higher castes on human development indicators is significant, reservation will continue to be necessary. The problem SCs face is complex because they battle not only discrimination but also isolation, antagonism, and humiliation.

If at all there needs to be any reform, it can’t be in the form of a creamy layer. It would be fair to exclude economically better sections of SCs from caste-based subsidised financial and other assistance. However, this can’t be extended to exclusion from reservation.

Data from 2022 found only 5% of SC workers are in government jobs. Although the share is low, it has brought some mobility. Individual mobility also induces group mobility because well-off people extend a helping hand to those who lag behind. I feel this spread effect of reservation is likely to be harmed by sub-categorisation and creamy layer. Therefore, any change in policy which involves a question of life and death for SCs should be determined by hard facts and not by unfounded assumptions.

Over 20 houses were set on fire by miscreants in a Dalit settlement in Bihar's Nawada district allegedly over a land dispute. Police said 15 people, including the prime suspect, have been arrested even as the RJD and Congress called the incident another proof of "jungle raj" prevailing in Bihar.

Initially, it was reported that over 80 houses were gutted in the incident on Wednesday night, but police have put the number at 21. A large contingent of police has been deployed in the area to prevent any flare-up.

The villagers have alleged that the miscreants stormed into their settlement and thrashed several Dalit families. The houses were then set ablaze and shots were also fired in the air.

However, Superintendent of Police Abhinav Dhiman denied reports of aerial firing, saying no shells were found by the police. He also said that no one was injured in the incident.

Bihar Chief Minister Nitish Kumar held a meeting with senior officials regarding the Nawada incident and directed the Additional Director General of Police (Law and Order) to personally visit the site and oversee the probe. A Special Investigation Team (SIT) has also been formed to further investigate the matter.

The government said strict action would be taken against the guilty and no one would be spared.

MAYAWATI, RAHUL GANDHI HIT OUT AT BIHAR GOVERNMENT

Tearing into the JD(U)-BJP government, Leader of Opposition Rahul Gandhi said the incident showed the dispensation's "utter indifference" towards Dalits and the deprived.

"Burning down an entire colony of Mahadalits in Nawada highlights the horrifying picture of injustice against the Bahujans in Bihar," Gandhi tweeted.

"Such anarchist elements find shelter under the leadership of the BJP and its NDA allies. "The Chief Minister of the third-largest party in Bihar has stopped speaking for months... the NDA is not concerned about Bihar but about criminals," he said.
