Cong workers, Dalits protest against top cop outside Gujarat Police HQ

Gandhinagar: Congress members and Dalit organizations from across the state staged a protest outside the Gujarat Police headquarters at Police Bhavan in Gandhinagar on Wednesday. They sought the removal of additional director general of police (ADGP) (SC/ST Cell) Rajkumar Pandian for his alleged misbehaviour with Congress MLA Jignesh Mevani and for “insulting the dignity, rights, and esteem of 50 lakh Dalits of Gujarat”.
Mevani wrote a letter to Union home minister Amit Shah and handed over a memorandum at the office of DGP Vikas Sahay. He reiterated his demand for the removal of the senior cop, alleging that he violated protocol by misbehaving with a sitting MLA when he went to his office on Oct 15 to make a representation about the rights of Dalits.
Several senior leaders of the state Congress, including state president Shaktisinh Gohil, joined the protest organized by the Rashtriya Dalit Adhikar Manch. The protestors raised slogans against the IPS officer and sought his removal from office.
“Keeping in mind the history of accusations and the consequential jail term undergone by Rajkumar Pandian, I do see myself threatened. I am compelled to say that if any harm is done to me, my life and property, or the life and property of my family, or the life and property of Hitendra Pithadiya, or the life and property of any of my team members, in any such case, Rajkumar Pandian should be held responsible,” he said in the letter to the DGP.
However, Pandian denied the allegations levelled against him, calling them “baseless”, and asserted the state police gave due importance to the welfare and safety of weaker sections of society, including Dalits and tribals.
“When (Mevani) came to meet me on Oct 15, I called him immediately inside without any delay by letting others wait. Instead of talking about the issue (of land encroachment), he started shouting in the chamber, saying ‘why I did not go outside to receive him and not follow protocols’,” he said. The IPS officer said the opposition party legislator put his mobile phone on his office table with its voice recorder on, which he objected to as unacceptable behaviour.
“Upon this, he (Mevani) started shouting. I asked him how I can attend to his grievance in a situation like this. I told him, either you do it properly or I will not give you time, you can approach a senior officer,” said the ADGP.
“Whenever there is any incident regarding SC/STs, we analyse them and write to the concerned CPs (Commissioners of Police) and SPs (Superintendent of Police) and address their grievances immediately,” he pointed out. (With PTI inputs)

“आरोपों के इतिहास और राजकुमार पांडियन द्वारा भुगती गई जेल की सज़ा को ध्यान में रखते हुए, मैं खुद को खतरे में देखता हूँ। मैं यह कहने के लिए मजबूर हूं कि यदि मुझे, मेरे जीवन और संपत्ति को, या मेरे परिवार के जीवन और संपत्ति को, या हितेंद्र पिथड़िया के जीवन और संपत्ति को, या मेरी टीम के किसी भी सदस्य के जीवन और संपत्ति को कोई नुकसान पहुंचता है। ऐसे किसी भी मामले में, राजकुमार पांडियन को जिम्मेदार ठहराया जाना चाहिए, ”उन्होंने डीजीपी को लिखे पत्र में कहा।

“इस पर, वह (मेवाणी) चिल्लाने लगे। मैंने उनसे पूछा कि ऐसी स्थिति में मैं उनकी शिकायत कैसे सुन सकता हूं। मैंने उनसे कहा, या तो आप इसे ठीक से करें या मैं आपको समय नहीं दूंगा, आप किसी वरिष्ठ अधिकारी से संपर्क कर सकते हैं, ”एडीजीपी ने कहा।

The Supreme Court has ordered an independent probe by two retired IPS officers into allegations of social boycott of Dalits by a “dominant community” at a village in Hisar district of Haryana.
“We request Vikram Chand Goyal and Kamlendra Prasad, both former DGPs of UP, to carry out an independent investigation into the prevailing situation and file a status report before this court so as to enable us to proceed further in this case,” a Bench led by Justice MM Sundresh ordered on October 16.
The Bench directed the two former DGPs to file a status report within three months, indicating not only the present situation but also the measures, if any, needed to be taken in connection with the allegations of social boycott of Dalits levelled in 2017. “We make it clear that there is no bar on the pending trial to proceed,” said the Bench, which also included Justice Aravind Kumar.
The Bench was informed that no untoward incident had taken place in recent times and “normalcy” was prevailing. It was also apprised of the fact that a chargesheet was filed on August 20, 2017, even as no arrests were made.
The Haryana Police gave a clean chit to six of the seven accused and they were not named in the chargesheet.
In June 2017, a group of Dalit boys was allegedly assaulted by members of a “dominant community” at a Hisar village over the use of a hand pump. An FIR was lodged after six persons were injured and hospitalised after being assaulted.
The top court was told that members of the dominant community, who were hostile to Dalits, were made prosecution witnesses and not a single Scheduled Caste certificate of the 28 complaints/victims of social boycott was taken by the police and submitted along with the chargesheet to the court.
Also, videos given to the police by the victims a call of social boycott given by the dominant community at a public meeting were not mentioned in the chargesheet or produced in court and the sanction for prosecution under Sections 153A and 505 of the IPC was taken belatedly only after the issue was raised by the complainants, the top court was told.
Told to file status report in 3 months
The Bench has directed the former DGPs to file a status report within three months
It has asked them to indicate not only the present situation but also steps, if any, needed to be taken in connection with the 2017 allegations of social boycott of Dalits

Not following court order proved costly for two accused in Agra, Uttar Pradesh. CJM found Zafar alias Shanu, resident of Navishah ki Dargah of Hariparvat police station area and Rahul, resident of Langde ki Chowki, guilty and sentenced them to three years imprisonment each.
According to the case registered in Jagdishpura police station, the then inspector DK Sisodia gave a report on March 1, 2017. It alleged that a notice under section 82 was issued by the court against Zafar alias Shanu, resident of Navishah ki Dargah of Hariparvat police station area and Rahul, resident of Langde ki Chowki.
The police team had also served the notice at the house of the accused. Even after this, the accused did not appear in the court. On the second day of filing the case, the police arrested the accused and sent them to jail.
Four years imprisonment to the accused of Dalit harassment and assault
The court found Girraj Singh, a resident of Khedia village of Iradat Nagar police station area, guilty of entering the house and assaulting the sanitation worker and Dalit harassment. Special Judge SC ST Act Rajendra Prasad sentenced the accused to four years imprisonment and a fine of Rs 41,000.
As per the case registered in Iradat Nagar police station, Dalchand had given a written complaint. In it, he alleged that his brother Manik Chand used to work as a cleaner at Bengali Babu’s office in the village itself. One day, his brother had to go to a relative’s house for some important work. Due to which he could not go to work for two days.
Angry with this, on 19 January 2007 at 9 am, the accused Girraj Singh and his father Bengali Babu entered his house and started abusing him. Later, they beat him and used casteist words. The police had presented the chargesheet against both the accused in the court. The son’s file was separated from his father’s.

Maintain SC, ST, OBC reservation roaster to ensure policy implementation: Railway Board to zones
New Delhi, Oct 23 (PTI) The Railway Board has advised all 17 railway zones and its public sector undertakings to properly maintain reservation roasters of SCs, STs and OBCs so that its effective implementation can be ensured.
In a written communication dated October 18 to the general managers of all the zones and the heads of the public sector undertakings as well as autonomous bodies, the board's Chairman and CEO Satish Kumar said that during the sitting of the Parliamentary Committee on Backward Classes held on September 9, the issue of proper implementation of reservation rules and maintenance of reservation rosters in the railways, particularly in its PSUs, were raised by various members.
"These issues have also been raised earlier by the National Commission for Backward Classes during meetings or hearings held," he wrote.
Kumar added that on May 3, the board emphasized all railway zones to ensure the proper implementation of extant reservation policies and the maintenance of reservation rosters both in recruitments and promotions, as per the laid down guidelines.
According to Kumar, apart from the above, another letter dated February 26 was exclusively addressed to the managing directors of all the PSUs under the Ministry of Railways, reiterating to follow the extant instructions or policies on reservation and to maintain reservation rosters appropriately as per the extant guidelines of the DOP&T.
Kumar advised seven steps to be followed by all zones and bodies to address the concerns of the Parliamentary Committee on Backward Classes and the National Commission for Backward Classes.
"Reservation Roster Registers are to be maintained as per the laid down guidelines of DOP&T/Railway Board issued from time to time in order to ensure proper implementation of extant reservation policies," the Railway Board chairman said.
"Posts reserved for SCs, STs, OBCs etc. as per Post-Based Reservation Rosters should be filled up by the earmarked category only and not by the UR (Unreserved) category. Reserved candidates selected on 'own merit' and not owing by reservation are not to be shown against reserved point," he added.
Kumar suggested that reservation rosters be inspected at regular intervals, at least twice a month, by the nominated liaison officers for SC/STs as well as by the liaison officers for OBC at all levels.
"During inspection, Roster Registers being checked and inspected are to be signed invariably by the Inspecting Liaison officer(s)," he added.
According to Kumar, the quantum of such inspection of roster registers carried out are to be mentioned by the officer in their respective APARs which would stand as an added attribute in the APAR for self-appraisal.
"A detailed report regarding inspection of Roster Registers carried out by the concerned officers is to be submitted to PCPOs/HOD for appraisal," he said.
Suggesting the last step to ensure proper implementation and maintenance of the said reservation policies Kumar stated, "While inspection of Roster Register, utmost care is to be given particularly in case of recruitment roster with respect to assessment of fresh vacancies as well as inclusion of backlog vacancies of SCs/STs/OBCs, based on which indent(s) have been placed for recruitment." The Railway Board chairman advised the bodies concerned to give a written confirmation to the effect that the extant reservation policies (SCs/STs/OBCs etc.) are being followed in their unit. Dehradun, 21 Oct: The BJP today expressed the hope of holding civic elections soon after the consent of the Select Committee on the previous reservation format. Addressing a press conference at the BJP State Headquarters today, Dharampur MLA Vinod Chamoli asserted that Congress should not indulge in politics of reservations and on the issue of slum colonies. Chamoli claimed that the BJP government has worked sincerely to save slums in the past and will be bringing an ordinance soon in this respect.
Chamoli claimed that the Pushkar Singh Dhami Government is moving decisively towards a permanent solution on the issues of slum colonies by determining the actual width of rivers through a hydrography survey. It may be recalled that Chamoli is a member of the Assembly Select Committee to make recommendations regarding reservation of wards for OBC category. He claimed that BJP is in favour of holding civic elections soon and bringing an ordinance to protect slums. Citing the decisions of the committee, he recalled that, after the directions of the Supreme Court, a single-member commission was constituted for OBC reservation. When its report was placed in the House, it was noted that OBC is a state subject, and hence reservation should be decided keeping in view the local conditions prevailing in the state. Consequently, a Select Committee was formed, which, after detailed discussions in three meetings that were held in this regard so far, it was decided that for the time being, civic elections may be held based on the 2018 election system as per the 2011 census. The BJP is also fully prepared to hold civic elections based on the previous system in the current circumstances.
Chamoli expressed hope that in next two to three days, the rules and roster will be prepared at the government level regarding reservation for women, SC, ST, and OBC for the civic polls. Thereafter, after completing the objections and other procedures, civic elections can be held in December.
The Dharampur MLA shared that the Select Committee felt the need for a detailed study on the subject of OBC reservation. Under a comprehensive study, the impact of this reservation will be examined, including its effects on the social fabric, educational environment, heritage, social impact, and political impact. The tenure of the committee has been extended by one month only so far but it can be extended further.
Regarding the regularisation of slums, Chamoli said that the party’s stand on this issue is clear that a permanent solution of this issue is necessary. In the current circumstances, it is essential to protect the affected people first. Previously, the BJP government had saved the slums by bringing an ordinance, and he expressed hope that another ordinance will be brought soon in this regard. The BJP MLA claimed that from the beginning, the BJP has been in favour of determining the actual width of the rivers because, until this happens, all processes like land conversion cannot be done for the regularisation of the slums. It is a matter of great satisfaction that, for the first time, the government has moved decisively towards fixing the width of the rivers by conducting a hydrological survey. Once this determination becomes final, the definition of the river bank or submerged land will also be decided, allowing for the regularisation of settlements by completing the land conversion process.
Chamoli emphasised that it is not appropriate to politicise this serious and sensitive issue. The BJP has worked to save the people of the slums from political and economic exploitation, ensured development work in the slums, brought them under the purview of tax, and worked on regularisation of slum colonies. The government is currently working on a permanent solution to this issue and will continue to do so.
Chamoli also reminded the media of the “rapid economic growth” of Uttarakhand in past few years and the sharp increase in the Per Capita Income of the state.
IPS Pandian Has Insulted the Dignity and Rights of 50 Lakh Dalits of Gujarat: MLA Mevani

Ahmedabad — Jignesh Mevani, the MLA from Vadgam, Gujarat, has formally written to Union Home Minister Amit Shah, urging the immediate suspension of Rajkumar Pandian, Additional Director General of Police (ADGP) for SC/ST, over alleged misconduct during a recent meeting. Mevani accused Pandian of disrespectful and improper behavior when the MLA sought to raise the issue of illegal encroachment on Dalit land in the Kutch District.

In the letter addressed to Shah, Mevani recounted the events of October 15, when he, along with Hitendra Pitadiya, Chairperson of the SC Cell of the Indian National Congress (INC), visited Pandian’s office in Ahmedabad. The meeting was arranged to address the encroachment of land that had been allotted to Dalit families in the 1980s. According to Mevani, while the land was officially allocated, physical possession has never been ensured, leaving the Dalit beneficiaries vulnerable to exploitation.
The land dispute, as Mevani outlined in his letter, has been a festering issue for decades. Despite multiple official allocations on paper, Dalits in the region have been unable to take control of their land due to illegal encroachments. The tension escalated last year when two Dalit men were killed for attempting to access their own land. On Independence Day this year, Mevani made a public call for authorities to enforce possession, prompting the Revenue Department to act by documenting the encroachments.
However, despite the acknowledgment of the illegal occupation, the local authorities have failed to take concrete action. Mevani stated that his repeated requests to the Superintendent of Police (SP) of Kutch to address the situation under the SC/ST (Prevention of Atrocities) Act were met with reluctance. The lack of response from both the SP and Range IG Chirag Koradiya led Mevani to seek an audience with ADGP Pandian.
