NEW DELHI Chief Justice of India B R Gavai has emphasised that judicial activism is bound to stay but cautioned that it should not be turned into judicial terrorism.

CJI Gavai said power of judicial review should be used sparingly and be used only if a statute is violative of the basic structure of the Constitution.

"Judicial activism is bound to stay. At the same time, judicial activism should not be turned into judicial terrorism. So, at times, you try to exceed the limits and try to enter into an area where, normally, the judiciary should not enter," he said in response to a question from a legal news portal.

Gavai described the Constitution as a "quiet revolution etched in ink" and a transformative force that not only guarantees rights but actively uplifts the historically oppressed.

Speaking at the Oxford Union in London on the theme 'From Representation to Realisation: Embodying the Constitution's Promise' on Tuesday, Gavai, the second Dalit and the first Buddhist to hold India's highest judicial office, highlighted the positive impact of the Constitution on marginalised communities and gave his example to drive home the point.

"Many decades ago, millions of citizens of India were called 'untouchables'. They were told they were impure. They were told that they did not belong. They were told that they could not speak for themselves. But here we are today, where a person belonging to those very people is speaking openly, as the holder of the highest office in the judiciary of the country," he said.

A Kaithal court has granted bail to a former registrar of a private varsity situated in the town in an alleged scholarship scam observing that “being an office-bearer in the administration of university, he might have played an active role to give undue benefit to owner of the university but he may not be the actual beneficiary of the alleged fraudulent amount”.

The Haryana Anti-Corruption Bureau (ACB) had arrested former registrar of NIILM university Sumesh Kumar Sharma on May 26 this year. The present case pertains to alleged embezzlement and mis-utilisation of funds of scholarship, which were meant for the upliftment of students belonging to the Scheduled Caste and Scheduled Tribe. The said misutilisation was allegedly done by the administration of NIILM University, Kaithal, during the academic year 2013-14 and 2014-15 by making fake admissions of students. After preliminary enquiry, an FIR was registered in 2018.

Sharma remained an employee of the university during 2012-14. He has been an associate professor of a Delhi-based institute since 2015.

After his arrest in the last week of May, Sharma through his counsel Sartaj Singh and Mahadev Maharaj Singh approached the court for his bail. However, the prosecution opposed his bail plea. The prosecution informed the court that there are 25 accused in the present case, including officials of the university and 17 brokers or agents who allegedly facilitated the admission process.

In its order of June 11, the court observed that many co-accused were either already granted anticipatory bail or regular bail. The court noted that the then in-charge of admissions in the university and its vice-chancellor were granted anticipatory bail in 2024 while the then chancellor of the university and wife of its owner was granted anticipatory bail in 2018. Now she is stated to have expired.

However, the court observed that the anticipatory bail application of the founder and de-facto owner of the university Vinay Rai was first dismissed by the district court and later by the Punjab and Haryana High Court. He is still at large and stated to be abroad, said the court. The court also observed that accused Sumesh Sharma, in his alleged disclosure statement, stated that he was acting as per the directions of university owner Vinay Rai, who is allegedly the main beneficiary.

In his order, Kaithal Additional Sessions Judge Dr Amit Kumar Garg held: “It is a well-known fact that the private employee has varying level of job security and stability; and one has to work as per the directions of his employer for his faster career growth because private sector is more vulnerable due to economic fluctuations, leading to higher job insecurity and lay-offs. In the private sector, career progression is based upon performance and so, one has to obey the command of his boss/employer.”

The court noted during the probe, no recovery of any cash has been made from the accused.

Ahmedabad Air Crash Claims Life of Payal, First Khatik Girl from Rajasthan's Gogunda Village to Study Abroad

The Khateek community, with around 200 families, had long struggled with financial constraints, making foreign education an unattainable dream, until Payal broke the barrier. Her success had filled the village with pride; now, it is shrouded in grief.

Udaipur- Payal Khatik, a 24-year-old nursing graduate from Udaipur district's Gogunda, was supposed to be the pride of her community—the first girl from her village to fly abroad for higher studies. She had earned admission to pursue an M.Sc degree in London. But fate had other plans. On Thursday, the Air India flight she boarded to London crashed shortly after takeoff in Ahmedabad, killing all on board and leaving her family shattered.

Payal’s father, Suresh Khatik, a rickshaw driver in Himmatnagar, and his wife had dropped their daughter at the airport with dreams in eyes. Minutes later, they received the devastating news—their daughter’s flight had crashed. They rushed to the hospital hoping and praying for her safety but their daughter had left them for ever.

Back in Gogunda, Payal’s grandmother, Sosar Bai, still doesn’t know her beloved granddaughter is gone. Neighbors, unable to break the news, tiptoe around her home, whispering in sorrow.

Sosar Bai has three sons Jagdish, Suresh and Kailash, all three settled in Gujarat for their livelihoods. Jagdish lives in Surat while the other two sons reside in Himmat Nagar. Suresh had two daughters, Payal and Komal and a son Shubraj, a student of grade 11.

Payal had completed a degree in Nursing from a college at Dabok in Udaipur. She recently quit her job to focus on her MSc in Nursing in London—a dream she nurtured while tutoring children after work. "She was hardworking, ambitious," a neighbor said, choking back tears. "She wanted to make her family proud."

Her journey was historic, no one from Gogunda’s Khatik community (a Dalit sub-caste) had ever gone abroad for studies. The Khatik community, with around 200 families, had long struggled with financial constraints, making foreign education an unattainable dream, until Payal broke the barrier. Her success had filled the village with pride; now, it is shrouded in grief.

Meanwhile, at Ahmedabad, the process of identifying victims from the tragic Air India Flight AI-171 crash continues at the Ahmedabad Civil Hospital, where bodies are being brought in for post-mortem examinations. As of now, five bodies have been identified and respectfully handed over to their families. These include two victims from Rajasthan, two from Bhavnagar, and one from Madhya Pradesh.

Civil Hospital officials confirmed that DNA samples have been collected from 192 families so far. To support the identification process, a large team of 70 to 80 doctors, including those from PHCs (Primary Health Centres) and CHCs (Community Health Centres) across Ahmedabad, Gandhinagar, Anand, and Nadiad, has been working around the clock in the post-mortem room since Thursday. The state government has set up a dedicated facility at the Kasoti Bhavan on the ground floor of B.J. Medical College for collecting DNA samples. Health Principal Secretary Dhananjay Dwivedi stated that samples, mainly from immediate family members like parents or children, are being sent for matching. The process is expected to take at least three days. To assist grieving families, the police and hospital staff are providing emotional support and ensuring that all formalities are handled with dignity and care.

As the process of identification continues, officials have confirmed that over 250 post-mortem examinations have already been completed. Earlier in the day, Prime Minister Narendra Modi arrived at the city’s Civil Hospital to meet those injured in the tragic incident and to express his condolences to the families of the deceased. At the hospital, PM Modi was received by Civil Hospital Superintendent Dr Rakesh Joshi, who provided a detailed briefing on the condition of the injured and the medical response underway. The Prime Minister also met with Ramesh Vishwas, the sole survivor of the crash, and other patients receiving treatment. He offered words of encouragement and support, assuring them of the government's full assistance during this difficult time. PM Modi spent time with grieving families, conveying his heartfelt condolences and standing in solidarity with them amid their profound loss.
