CPI alleges increase in atrocities against Dalits, adivasi

Members of the Communist Party of India (CPI) staged a demonstration in the city on Tuesday against what it called increase in atrocities against Dalits, adivasis, women, and minorities in the country.

The protesters attributed the atrocities to the prevailing mindset in the society, which, it said, was shaped by caste discrimination encouraged by the Manusmirti.

They regretted that such atrocities continue to take place in the society in the present times long after the country has become democractic. Instead of a reduction in such crime, the atrocities are on the rise, the CPI alleged.

Citing statistics from the National Crimes Record Bureau, the CPI said that there were 57,000 recorded cases of atrocities against the Dalits in 2023 while there were 2,835 rape cases in which Dalit women were victims.

They said these were only the registered cases while the actual numbers could be much higher.

The rise in crime was also attributed to rise in communalism in the country and called for greater unity among the people to fight the scourge.

The accused had physical relations with the woman after promising marriage, but later broke off the relationship and even assaulted her, citing her Scheduled Caste (SC) identity.

In his judgment delivered on November 3, High Court Justice S. Rachaiah clearly stated that this is a serious offense under the SC/ST (Prevention of Atrocities) Act, and bail is strictly prohibited under Section 18A. The court stated, “It is clear from the allegations in the complaint that the accused refused to accept her as his wife because she belonged to a Scheduled Caste. The essential elements of the crime are established. Therefore, he is not entitled to anticipatory bail under Section 18A of the said Act.”

The case relates to the Amrutur police station in Tumkur district, where both the accused constable and the victim were posted as colleagues. According to the prosecution, the incident began on February 14, 2023, when the accused arrived at the victim’s official residence. There, he expressed his desire to marry her and performed a simple wedding ceremony in front of a picture of Sai Baba. The accused assured the victim that the marriage would be kept secret until the caste dispute was resolved.

Following this, the accused had physical relations with the victim several times, but did not allow her to wear a mangalsutra, fearing it would cause problems for both of them. The victim, trusting him, remained silent. However, when she demanded that the marriage be made public, the accused flatly refused. His excuse was that the victim belonged to a Scheduled Caste, while he himself belonged to a different caste. Not only did he refuse, but when she insisted on marriage, the accused also assaulted her. Hurt and betrayed, the victim finally filed a complaint, based on which the Amritsar police registered Crime No. 81/2025.

Legal provisions applied in the case

The accused has been charged under sections 318(2) (cheating), 352 (assault), 115(2) (criminal conspiracy), 351(2) (criminal intimidation), 54 (concealment of an offence), and 74 (abetment of an offence) of the Indian Penal Code (IPC), 2023, as well as section 3(5). Additionally, sections 3(1)(r) (insult on grounds of caste), 3(1)(s) (cheating on grounds of caste), 3(1)(w)(i) (caste-based offences), and 3(2)(va) (group offences on grounds of caste) of the SC/ST (Prevention of Atrocities) Act, 1989 (Amendment 2015) have also been added.

The case is pending in the court of the Additional District and Sessions Judge, Tumkur. The trial court had rejected the accused’s bail plea (CRL.Miss.761/2025) on June 9, against which the accused filed an appeal under Section 14(A)(2) of the SC/ST Act. This appeal was filed in the Karnataka High Court as CRL.A No. 1363/2025, where the SPP appeared for the State and the lawyer appeared for the victim.

The accused said the victim had proposed marriage. The appeal hearing took place on September 26th, where the accused’s lawyer, Dayanand Hiramath, presented a powerful argument. He claimed that the entire case was fabricated and that the victim had proposed marriage. When the accused refused, false allegations were made as revenge. The lawyer stated that there was no concrete evidence that the accused had married or physically abused her. He also refuted the caste-based denial, stating that mere allegations do not prove a crime.

The lawyer also emphasized the accused’s personal hardship. The accused is a police constable and the sole earning member of the family. He is a permanent resident of Manapura village in Sindgi taluk, Vijayapura district. Failure to grant bail would cause financial hardship to the entire family. The lawyer requested that anticipatory bail be granted with strict conditions, stating that the accused is willing to comply with the court’s conditions.

On the other hand, High Court government lawyer Waheeda M.M., representing the state, strongly objected. Citing the facts of the complaint, she argued that the accused deliberately lured the victim into a love affair. He engaged in physical relations with her repeatedly under the false promise of marriage, but when it came to granting her wifely status, he used caste as an excuse. She stated that the accused refused to recognize the victim as his wife and assaulted her. This constituted clear caste-based atrocity under the SC/ST Act. The lawyer cited Section 18A, which prohibits bail in such cases, and demanded that the appeal be dismissed so as not to hamper the investigation.

The High Court rejected the bail plea for this reason.

After hearing arguments from both parties, the High Court thoroughly reviewed the complaint record. Justice Rachaiah reiterated the facts in the judgment. He wrote that both the accused and the victim worked as constables at the Amritur police station. They grew close, leading to a decision to marry. According to the victim, the accused married her in front of a photo of Sai Baba at her home and began living as husband and wife. They had physical relations several times, but he avoided making a public announcement. When the victim insisted, the accused deceived her by citing caste.

The court stated, “According to the victim, the accused married her in front of a photo of Sai Baba and engaged in physical relations several times, but refused to accept her as his wife. When she insisted, he deceived her by citing caste.” The court held that the allegations in the complaint attracted elements of the offense under the SC/ST Act. Therefore, bail cannot be granted due to the prohibition of Section 18A. The appeal was dismissed, and the accused will have to face trial.

"आप दलित हैं, आप शादी नहीं कर सकते": कर्नाटक HC ने शादी के बहाने एक महिला के साथ संबंध बनाने के आरोपी कांस्टेबल को जमानत देने से इनकार कर दिया, इसे स्पष्ट जातीय अत्याचार बताया...

हाई कोर्ट ने कहा, "पीड़िता के मुताबिक, आरोपी ने साईं बाबा की तस्वीर के सामने उससे शादी की और कई बार उसके साथ शारीरिक संबंध बनाए, लेकिन उसे अपनी पत्नी के रूप में स्वीकार करने से इनकार कर दिया। जब उसने जिद की तो उसने जाति का बहाना बनाकर उसे धोखा दिया।"

बेंगलुरु – कर्नाटक उच्च न्यायालय ने एक दलित महिला को प्यार के नाम पर धोखा देने के मामले में आरोपी एक पुलिस कांस्टेबल की अग्रिम जमानत याचिका खारिज कर दी है। आरोपी ने शादी का वादा करने के बाद महिला के साथ शारीरिक संबंध बनाए, लेकिन बाद में रिश्ता तोड़ दिया और उसकी अनुसूचित जाति (एससी) पहचान का हवाला देते हुए उसके साथ मारपीट भी की।

3 नवंबर को दिए गए अपने फैसले में, उच्च न्यायालय के न्यायाधीश एस. रचैया ने स्पष्ट रूप से कहा कि एससी/एसटी (अत्याचार निवारण) अधिनियम के तहत यह एक गंभीर अपराध है, और धारा 18ए के तहत जमानत सख्त वर्जित है। अदालत ने कहा, "शिकायत में आरोपों से यह स्पष्ट है कि आरोपी ने उसे अपनी पत्नी के रूप में स्वीकार करने से इनकार कर दिया क्योंकि वह अनुसूचित जाति से थी। अपराध के आवश्यक तत्व स्थापित हो गए हैं। इसलिए, वह उक्त अधिनियम की धारा 18 ए के तहत अग्रिम जमानत का हकदार नहीं है।"

जानिए पूरे मामले के बारे में

मामला तुमकुर जिले के अमृतूर पुलिस स्टेशन का है, जहां आरोपी कांस्टेबल और पीड़िता दोनों सहकर्मी के रूप में तैनात थे। अभियोजन पक्ष के अनुसार, घटना 14 फरवरी, 2023 को शुरू हुई, जब आरोपी पीड़िता के आधिकारिक आवास पर पहुंचे। वहां, उन्होंने उससे शादी करने की इच्छा व्यक्त की और साईं बाबा की तस्वीर के सामने एक साधारण विवाह समारोह आयोजित किया। आरोपी ने पीड़िता को आश्वासन दिया कि जाति विवाद सुलझने तक शादी को गुप्त रखा जाएगा।

इसके बाद आरोपी ने पीड़िता के साथ कई बार शारीरिक संबंध बनाए, लेकिन उसे मंगलसूत्र नहीं पहनने दिया, क्योंकि उसे डर था कि इससे उन दोनों के लिए समस्या पैदा हो जाएगी। पीड़िता उस पर भरोसा कर चुप रही। हालांकि, जब उसने शादी को सार्वजनिक करने की मांग की तो आरोपी ने साफ इनकार कर दिया। उनका बहाना यह था कि पीड़िता अनुसूचित जाति से थी, जबकि वह खुद अलग जाति से थे. उसने न सिर्फ मना कर दिया, बल्कि जब उसने शादी की जिद की तो आरोपी ने उसके साथ मारपीट भी की। आहत और धोखा खाए पीड़िता ने आखिरकार शिकायत दर्ज कराई, जिसके आधार पर अमृतसर पुलिस ने अपराध संख्या 81/2025 दर्ज किया।

मामले में कानूनी प्रावधान लागू

आरोपी पर भारतीय दंड संहिता (आईपीसी), 2023 की धारा 318(2) (धोखाधड़ी), 352 (हमला), 115(2) (आपराधिक साजिश), 351(2) (आपराधिक धमकी), 54 (अपराध को छुपाना), और 74 (अपराध के लिए उकसाना) के साथ-साथ धारा 3(5) के तहत आरोप लगाया गया है। इसके अतिरिक्त, एससी/एसटी (अत्याचार निवारण) अधिनियम, 1989 (संशोधन 2015) की धारा 3(1)(आर) (जाति के आधार पर अपमान), 3(1)(एस) (जाति के आधार पर धोखाधड़ी), 3(1)(डब्ल्यू)(आई) (जाति-आधारित अपराध), और 3(2)(वीए) (जाति के आधार पर समूह अपराध) को भी जोड़ा गया है।

मामला तुमकुर के अतिरिक्त जिला एवं सत्र न्यायाधीश की अदालत में लंबित है। ट्रायल कोर्ट ने 9 जून को आरोपी की जमानत याचिका (CRL.Miss.761/2025) खारिज कर दी थी।जिसके खिलाफ आरोपी ने एससी/एसटी एक्ट की धारा 14(ए)(2) के तहत अपील दायर की। यह अपील कर्नाटक उच्च न्यायालय में सीआरएल.ए संख्या 1363/2025 के रूप में दायर की गई थी, जहां एसपीपी राज्य की ओर से और वकील पीड़ित की ओर से पेश हुए थे।

आरोपी ने बताया कि पीड़िता ने शादी का प्रस्ताव रखा था। अपील की सुनवाई 26 सितंबर को हुई, जहां आरोपी के वकील दयानंद हिरामथ ने एक शक्तिशाली तर्क प्रस्तुत किया। उन्होंने दावा किया कि पूरा मामला मनगढ़ंत है और पीड़िता ने शादी का प्रस्ताव दिया था. जब आरोपी ने मना कर दिया तो बदला लेने के लिए झूठा आरोप लगाया गया। वकील ने कहा कि इस बात का कोई ठोस सबूत नहीं है कि आरोपी ने उससे शादी की थी या उसका शारीरिक शोषण किया था। उन्होंने जाति आधारित खंडन का भी खंडन किया और कहा कि केवल आरोप लगाने से अपराध साबित नहीं होता।

वकील ने अभियुक्त की व्यक्तिगत कठिनाई पर भी जोर दिया। आरोपी एक पुलिस कांस्टेबल है और परिवार का एकमात्र कमाने वाला सदस्य है। वह विजयपुरा जिले के सिंदगी तालुक के मनापुरा गांव का स्थायी निवासी है। जमानत न देने पर पूरे परिवार को आर्थिक परेशानी होगी। वकील ने सख्त शर्तों के साथ अग्रिम जमानत देने का अनुरोध करते हुए कहा कि आरोपी अदालत की शर्तों का पालन करने को तैयार है।

वहीं, सरकार की ओर से पैरवी कर रही हाई कोर्ट की सरकारी वकील वहीदा एम.एम. ने कड़ी आपत्ति जताई. शिकायत के तथ्यों का हवाला देते हुए उसने तर्क दिया कि आरोपी ने जानबूझकर पीड़िता को प्रेम संबंध में फंसाया। वह शादी के झूठे वादे के तहत उसके साथ बार-बार शारीरिक संबंध बनाता रहा, लेकिन जब उसे पत्नी का दर्जा देने की बात आई तो उसने जाति का बहाना बनाया। उसने कहा कि आरोपी ने पीड़िता को अपनी पत्नी के रूप में पहचानने से इनकार कर दिया और उसके साथ मारपीट की। यह एससी/एसटी अधिनियम के तहत स्पष्ट रूप से जाति-आधारित अत्याचार का गठन करता है। वकील ने धारा 18ए का हवाला दिया, जो ऐसे मामलों में जमानत पर रोक लगाती है, और मांग की कि अपील खारिज कर दी जाए ताकि जांच में बाधा न आए।

इसी वजह से हाई कोर्ट ने जमानत याचिका खारिज कर दी.

दोनों पक्षों की दलीलें सुनने के बाद, उच्च न्यायालय ने शिकायत रिकॉर्ड की गहन समीक्षा की। न्यायमूर्ति रचैया ने फैसले में तथ्यों को दोहराया। उन्होंने लिखा कि आरोपी और पीड़ित दोनों अमृतुर पुलिस स्टेशन में कांस्टेबल के रूप में काम करते थे। उनके बीच नजदीकियां बढ़ीं, जिसके बाद उन्होंने शादी करने का फैसला लिया। पीड़िता के मुताबिक आरोपी ने उसके घर पर साईं बाबा की तस्वीर के सामने उससे शादी की और पति-पत्नी की तरह रहने लगा. उनके बीच कई बार शारीरिक संबंध बने, लेकिन उन्होंने सार्वजनिक घोषणा करने से परहेज किया। जब पीड़िता ने जिद की तो आरोपी ने जाति का हवाला देकर उसे धोखा दिया।

अदालत ने कहा, "पीड़िता के अनुसार, आरोपी ने साईं बाबा की तस्वीर के सामने उससे शादी की और कई बार शारीरिक संबंध बनाए, लेकिन उसे अपनी पत्नी के रूप में स्वीकार करने से इनकार कर दिया। जब उसने जोर दिया, तो उसने जाति का हवाला देकर उसे धोखा दिया।" अदालत ने माना कि शिकायत में लगाए गए आरोप एससी/एसटी अधिनियम के तहत अपराध के तत्वों को आकर्षित करते हैं। अत: धारा 18ए की रोक के कारण जमानत नहीं दी जा सकती। अपील खारिज कर दी गई और आरोपी को मुकदमे का सामना करना होगा।

Himachal: Organizations took to the streets in Nahan against Dalit oppression, submitted a 12-point memorandum to the Chief Minister.

The 12-point demands, including the investigation of pending cases under the SC/ST Act, the arrest of the culprits, and the formation of a clean-up commission, were submitted to the Chief Minister.

Nahan (Sirmaur). Dalit organizations held a strong protest in Nahan on Monday against the increasing atrocities, discrimination, and rights violations against the Dalit community in Himachal Pradesh. Representatives from more than eight organizations, united under the banner of the “Dalit Shoshan Mukti Manch,” held a protest rally and presented their demands to the state government.

The protest began at the Hindu Ashram in Nahan and passed through various parts of the city, culminating at the Deputy Commissioner’s (DC) office. Here, the protesters, led by the forum’s state convener, Ashish Kumar, submitted a 12-point memorandum of demands to the Chief Minister through the Deputy Commissioner.

Anger over recent incidents

Prior to the rally, a joint convention of various Dalit organizations was held at the Hindu Ashram. Ashish Kumar inaugurated the convention, while Satpal Mann moderated the forum.

In his address, Ashish Kumar stated that incidents of atrocities against Dalits have increased in the state in recent times. He specifically mentioned the suspicious death of Dalit student Sikandar in Rohru and the fatal attack and death of a Dalit woman in Sainj, Kullu. He stated that these incidents have created deep resentment within the Dalit community across the state.

Formation of a New Committee

During the convention, a 31-member committee was also formed to formulate future strategies and strengthen the organization. Rajesh Tomar was unanimously elected as the convener, and Vijay Chauriya, Prasan Tomar, and Praveen Sodha were elected co-conveners.

Key Demands Included in the Memorandum

The memorandum sent to the Chief Minister includes several important demands related to the safety and rights of the Dalit community. The forum’s key demands are:

• Justice and Law: Pending cases registered under the SC/ST (Prevention of Atrocities) Act should be investigated in a timely and impartial manner, and the culprits should be immediately arrested.
• Reservation and Funds: An SC/ST Development Fund Act should be enacted in the state, modeled after Telangana, and the 85th Constitutional Amendment should be fully implemented. The reservation roster should be strictly followed in new recruitments.
• Victim Relief: Immediate financial assistance should be provided to families affected by harassment.
• Education: Timely payment of scholarships to Dalit students should be ensured.
• Monitoring: A state-level monitoring committee should be formed to investigate discrimination in government and educational institutions.
• Budget: The budget allocated for SC/ST welfare schemes should be utilized 100%, and a public report should be released.
• Sanitation Workers: Sanitation workers should be regularized in the state, the contract system should be abolished, and a ‘Sanitation Commission’ should be established in Himachal Pradesh, modeled after Delhi, Punjab, and Karnataka.

The victim has been identified as Achal Kumar, a resident of nearby Paina Khurd. Officials said Achal had an ongoing legal dispute with some upper caste men in the area. On Sunday, he accidentally entered Paina Buzurg while selling vegetables. He was then surrounded by Chutakke Singh and his group, who assaulted him. A local resident filmed the attack and posted it online, which created more tension in the village.

Achal later filed a complaint with the police. A case has been registered under the appropriate sections. Sidhouli Circle Officer Praveen Malik said, “We have arrested the main accused and the investigation is continuing.” He also said that the violence appeared to be a result of an old rivalry between the two sides. “The victim has been medically examined and the situation is under control,” he added.

NCSK seeks a detailed report on the deaths of two sanitation workers in Mumbai's STP tank, highlighting manual scavenging violations and safety lapses.

MUMBAI: A week after two sanitation workers died inside a sewage treatment plant (STP) tank in a Powai housing society, the National Commission for Safai Karamcharis (NCSK) has taken cognisance of the deaths and has asked the Mumbai Suburban Collector to file a detailed report on the incident and the action taken so far.

The move follows a complaint by Pune-based lawyer Sagar Ratan Charan, who termed the incident a clear case of manual scavenging, a practice outlawed under the Prohibition of Employment as Manual Scavengers and Their Rehabilitation Act, 2013.

The report must include, as per the NCSK’s email, a copy of the FIR with a mention of the relevant sections of Manual Scavenging Act, 2013, assurance of a ₹30 lakh compensation to the victims’ families, over a ₹10 lakh life insurance paid to the families.

After the death of Akshay Mandal, 22, and Phulchand Kumar, 28, who went in to rescue an unconscious Mandal on Wednesday - Mandal died before reaching Hiranandani Hospital after they were rescued by the fire brigade, and Kumar later in the night at the hospital, the Powai police initially registered an accidental death report (ADR). On Friday, an FIR was filed against the deceased Kumar, the supervisor and owner of a private agency for not following proper safety precautions under the provisions of the Prevention of Manual Scavenging Act, 2013 on Friday. The workers were employed by Ultra Tech Pvt Ltd to clean the tank in the Raj Grandeur Housing Society in Powai.

Activists demand a memorial at bungalows where Ambedkar stayed in Sambhajinagar

Chhatrapati Sambhajinagar: Social activists have raised the demand to convert the bungalows where Dr BR Ambedkar stayed for nine years in the Cantonment area of Chhatrapati Sambhajinagar into an international memorial.

In a detailed presentation before the state and the Centre, a demand was made to develop 32 acres of land surrounding these bungalows into a multi-storey memorial.

Veteran author Hrishikesh Kamble, who met Union transport minister Nitin Gadkari in Nagpur recently to press for the memorial, said an international library, multiple research centres, and a spacious garden on the lines of the garden at Rashtrapati Bhavan can be set up in the Cantonment area.

"Ambedkar made the bungalows his home during the formative years of the People's Education Society in the then Aurangabad. He lived there for more than nine years. The place deserves to be developed as an international memorial," Kamble said.

Former corporator Vijay Nikalaje said Union minister Kiren Rijiju visited the bungalows during his recent tour to Chhatrapati Sambhajinagar. "Rijiju said.

Won’t leave forest, will sacrifice lives for rights, declare Adivasis

Khanapur: Declaring that they won’t forest, the Adivasi Kolam community declared that they have been living in forest areas since before India’s independence, continuing their traditional way of life.

They accused the government of conspiring to evict them from the forests and prevent them from building houses, despite laws meant to protect their rights.

Kolam Seva Sangham State president Kodapa Sonerav warned: “We are not ready to leave. If forced, we will not hesitate to sacrifice our lives.” On Monday, Adivasis staged a massive protest in front of the ITDA Utnoor office, marching there in a rally. They raised slogans against both Central and State governments, accusing them of obstructing their development.

They questioned the local ruling party MLA: “Doesn’t he know our problems? Didn’t we vote for him? Isn’t he himself an Adivasi MLA?”

Sonerav criticised forest officials for blocking the construction of permanent houses, even though funds were sanctioned for PVTG (Particularly Vulnerable Tribal Groups) development. He said that when huts are demolished, children and elders suffer in the cold.

He reminded that Adivasis are not outsiders but have lived in forests since the times of their ancestors, long before 1930, 1947, and 1956. Instead of catching real forest offenders, officials allegedly take photos of innocent Kolam tribals, file false cases, and send them to jail. He vowed to continue the struggle until their issues are resolved.

Khanapur MLA Vedma Bojju Patel, along with ITDA PO Yuvraj Marmat, reached the protest site. He recalled that he had earlier warned officials: “If you harass Adivasis and obstruct their development, we will tie you to trees and beat you.”

Patel said he had already discussed PVTG issues with the Chief Minister and the Forest Minister. He assured that the state government provides Rs 3.75 lakh and the Central government contributes Rs1.75 lakh for house construction. He emphasized that even as a ruling party MLA, he is fighting with officials for Adivasi rights.

He warned: “If any officer tries to forcibly evict Adivasis from forests without bringing the matter to my notice, I will not tolerate it. If Adivasis lose patience, who can stop them?” He promised to work for a complete resolution of PVTG issues and even invited them to protest in front of his house if problems remain unresolved.

Patel criticised district-level officials for sitting in AC rooms while pushing responsibilities onto lower-level staff. Leaders from various organisations extended full support. The protest saw participation from Kolam Seva Sangham State vice president Kumra Raju, honorary president Tekam Laxman, district president Madavi Govind Rao, Asifabad district president Atram Jalapath Rao, Tekam Ganesh, Madavi Kishan, women leaders Nagubai and Lakshmibai, and Raj Gond Seva Samiti State general secretary Mangam Visham Rao, among many others.
