Subject: Request for collective action for strengthening the constitutional rights and protection of Scheduled Castes and Scheduled Tribes in Tamil Nadu.
Respected Hon'ble Members,
I respectfully submit this representation requesting your collective intervention on issues affecting the constitutional rights, protection, development and representation of Scheduled Castes (SCs) and Scheduled Tribes (STs) in Tamil Nadu.
As elected representatives from SC/ST reserved constituencies, you have a particularly important constitutional and democratic responsibility to ensure that the guarantees provided under the Constitution reach the people at the grassroots level.
I respectfully request that the following matters be taken up collectively in the Tamil Nadu Legislative Assembly:
1)SC/ST (Prevention of Atrocities) Act.
Strengthen implementation of the Act throughout Tamil Nadu.
Ensure prompt registration of FIRs and investigation of atrocity cases.
Strengthen Special Courts and Special Public Prosecutor arrangements.
Ensure timely compensation and rehabilitation of victims and families.
2) SC/ST Special Police Stations to open.
Establish adequately staffed and properly functioning SC/ST Special Police Stations in districts/areas with a high incidence of atrocities.
Ensure trained investigating officers and effective monitoring.
3)SC/ST Special Courts
Establish sufficient exclusive/special courts for speedy disposal of atrocity cases.
Publish district-wise pendency and disposal statistics.
Land rights
Protect SC/ST land from illegal occupation and alienation.
Conduct a district-wise survey of assigned/Adi Dravidar and Tribal land.
Restore illegally alienated government-assigned land wherever legally possible.
4)Ensure effective implementation of Forest Rights Act, 2006, wherever applicable.
5)Education
Strengthen SC/ST hostels, scholarships and educational support.
Improve access to higher education, professional education and competitive examinations.
Monitor dropout rates among SC/ST students.
6)Employment and reservation.
Fill backlog vacancies in government departments and public institutions.
Publish department-wise SC/ST reservation and backlog vacancy data.
Strengthen reservation monitoring and prevent circumvention of reservation provisions.
7)Economic development.
Strengthen financial assistance, entrepreneurship programmes, skill development and self-employment schemes for SC/ST communities.
Publish district-wise expenditure and beneficiary data for SC/ST welfare programmes.
Political and administrative representation
Ensure effective participation of SC/ST representatives in local bodies and decision-making institutions.
Strengthen the functioning of statutory commissions and monitoring mechanisms for SC/ST welfare.
Basic infrastructure
Give priority to SC/ST habitations in roads, drinking water, sanitation, housing, electricity, health centres and public transport.
Prepare district-wise development indicators for SC/ST habitations.
Transparency and accountability.
Place an annual Tamil Nadu SC/ST Development and Protection Report before the Legislative Assembly.
Include district-wise data on atrocities, FIRs, convictions, compensation, land restoration, scholarships, employment and welfare expenditure.
Request for a collective initiative
I respectfully request the Hon'ble SC/ST MLAs to consider forming a cross-party SC/ST Legislators' Coordination Forum
within the constitutional and legislative framework, so that issues affecting SC/ST communities can be discussed regularly and pursued irrespective of political party.
I also request the Hon'ble Members to consider raising these matters through:
Assembly Questions;
Calling Attention motions;
Special mentions;
Discussions on the Budget and Demand for Grants;
Committee proceedings; and
Appropriate resolutions wherever permissible under the Assembly Rules.
The objective is not political confrontation, but effective implementation of the Constitution and existing laws and schemes for the protection and advancement of SC/ST citizens.
I therefore humbly request all Hon'ble SC/ST MLAs to work collectively for a stronger system of protection, representation, education, employment,
land rights and economic development for Scheduled Castes and Scheduled Tribes in Tamil Nadu.
