Urgent request for establishment of dedicated SC/ST Special Police Stations in atrocity-prone districts and areas of Tamil Nadu, strengthening of SC/ST Special Courts, and strengthening of the Tamil Nadu State Commission for Scheduled Castes and Scheduled Tribes.

We respectfully submit this representation seeking urgent institutional measures to prevent atrocities against Scheduled Castes and Scheduled Tribes and to ensure speedy investigation, prosecution, protection and justice to victims.

Tamil Nadu has a long and distinguished tradition of social justice. However, incidents of caste-based violence, social exclusion, intimidation, land disputes, assaults, sexual violence, destruction of property and other offences against SC/ST persons continue to require a stronger specialised institutional response.

The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, together with the Rules, provides a comprehensive framework for prevention of atrocities, investigation, prosecution, Special Courts, protection of victims and witnesses and relief and rehabilitation.

We therefore request the Government of Tamil Nadu and all elected SC/ST Members of the Legislative Assembly to give priority to the following demands.

1. INDIA HAS ONLY 181 DEDICATED SC/ST SPECIAL POLICE STATIONS

The latest Annual Report 2025–26 of the Ministry of Social Justice and Empowerment, Government of India, states that 181 Special Police Stations have been set up under the SC/ST (Prevention of Atrocities) Act in only seven States/UTs.

A Parliamentary Standing Committee also highlighted the fact that only these seven jurisdictions have established such dedicated police stations.

Tamil Nadu position.

Tamil Nadu is not included among these seven jurisdictions.

Therefore, Tamil Nadu should urgently establish dedicated SC/ST Special Police Stations/Special Investigation Units in districts and areas where atrocities are prevalent.

This should not be regarded merely as creation of another police establishment. It should be regarded as a specialised justice and victim-protection mechanism.

2. TAMIL NADU ALREADY HAS ATROCITY-PRONE AREAS

Government material has previously recorded 345 villages in 38 districts of Tamil Nadu as atrocity-prone, in addition to identified atrocity-prone villages in Commissionerates.

This provides a strong basis for creating dedicated police infrastructure.

We therefore request that the Government undertake a fresh statewide scientific mapping of atrocity-prone villages, blocks and districts, using:

SC/ST atrocity cases;

repeated offences;

caste violence;

murder and mass violence;

sexual offences;

land/property conflicts;

social/economic boycotts;

untouchability practices;

intimidation of witnesses;

displacement of SC/ST families; and

history of previous atrocity incidents. 

3)FIRST PHASE:

 KINDLY ESTABLISH SPECIAL POLICE STATIONS IN HIGH-PRIORITY DISTRICTS.

We request that the Government establish dedicated SC/ST Special Police Stations initially in high-priority districts, including:

Priority Phase I

Dharmapuri

Coimbatore

Madurai

Virudhunagar.

Thereafter, the programme should be extended to other districts identified through official atrocity data.

The stations should not merely carry the name "SC/ST Police Station". They should have:

Dedicated investigating officers;

Officers trained in the SC/ST (Prevention of Atrocities) Act;

Women police officers;

Adequate staff and vehicles;

Forensic and evidence-collection support;

Victim and witness protection arrangements;

Legal assistance coordination;

Direct coordination with Special Public Prosecutors;

Monthly review of pending investigations; and

Senior police supervision.

4. SPECIAL ARRANGEMENT FOR MASS ATROCITIES AND MASS VIOLENCE.

Where an incident involves:

Multiple deaths;

Mass assault;

Mass sexual violence;

Burning/destruction of houses;

Large-scale displacement;

Organised caste violence;

Destruction of SC/ST property; or

Repeated attacks against a particular SC/ST settlement,

the case should automatically receive senior-level investigation and monitoring.

A Special Investigation Team headed by an officer of appropriate seniority should be constituted wherever circumstances warrant.

Victims and witnesses must not be forced into compromise or settlement because of threats, social pressure or economic dependence.

5. SPECIAL COURTS – STRENGTHEN EXISTING SYSTEM.

Tamil Nadu already has Exclusive Special Courts under the SC/ST (Prevention of Atrocities) Act.

Government material records 14 Exclusive Special Courts in Tamil Nadu, covering districts including Tiruchirappalli, Thanjavur, Madurai, Tirunelveli, Villupuram, Sivagangai, Dindigul, Ramanathapuram, Virudhunagar/Srivilliputhur, Pudukkottai, Cuddalore, Namakkal, Theni and Tiruvannamalai. In other districts, existing Sessions Courts have been designated as Special Courts.

Therefore, our demand is not that Tamil Nadu has no Special Courts.

Our demand is:

"Strengthen and expand the Exclusive Special Court system according to the incidence and pendency of SC/ST atrocity cases."

Particular consideration should be given to:

Additional Exclusive Special Courts in high-case-load districts;

Adequate judicial and administrative staff;

Dedicated Special Public Prosecutors;

Victim/witness support;

Time-bound disposal;

Digital case monitoring; and

Periodic review of acquittals, delays and pending trials.

6. TAMIL NADU STATE COMMISSION FOR SC/ST – FULLY CONSTITUTE AND STRENGTHEN IT.

Tamil Nadu enacted the Tamil Nadu State Commission for the Scheduled Castes and Scheduled Tribes Act, 2021, providing for a State Commission for SCs and STs.

The Commission was established as an autonomous body to safeguard the legal rights and interests of SC/ST communities.

However, recent reporting indicates that the Chairperson's position is presently vacant.

We therefore request:

The Tamil Nadu Government should immediately:

Appoint a qualified Chairperson;

Ensure that all statutory positions are filled;

Provide adequate staff and financial resources;

Establish district-level complaint mechanisms;

Strengthen its investigation and inquiry capacity;

Ensure prompt action on complaints of atrocities and discrimination;

Publish annual reports;

Monitor implementation of the SC/ST (Prevention of Atrocities) Act;

Coordinate with the Police, Revenue Department, Social Welfare/Adi Dravidar Welfare and Tribal Welfare Departments; and

Place important recommendations before the Government with a time-bound Action Taken Report.

7. THREE-PILLAR SC/ST JUSTICE SYSTEM FOR TAMIL NADU.

We respectfully propose that Tamil Nadu establish the following integrated system:

PILLAR – I

Dedicated SC/ST Special Police Stations

For prevention, FIR registration, investigation, victim protection and evidence collection.

PILLAR – II

Exclusive SC/ST Special Courts

For speedy and effective trial of atrocity cases.

PILLAR – III

Strong and Independent State SC/ST Commission

For monitoring constitutional and statutory safeguards, investigating complaints and ensuring accountability.

These three institutions should function in coordination but remain institutionally distinct.

8. DISTRICT SC/ST ATROCITY MONITORING COMMITTEE.

A permanent District SC/ST Atrocity Monitoring Committee should review cases every month.

It may include:

District Collector;

Superintendent of Police;

Senior SC/ST Police Officer;

Special Public Prosecutor;

District Legal Services Authority representative;

District Adi Dravidar Welfare Officer;

Tribal Welfare representative where applicable;

Representatives of the State SC/ST Commission; and

Other appropriate officials.

The Committee should monitor:

FIR registration;

Investigation;

Arrest;

Charge-sheet filing;

Bail;

Victim protection;

Witness protection;

Relief and compensation;

Rehabilitation;

Land/property restoration;

Trial progress; and

Conviction/acquittal.

9. ANNUAL PUBLIC REPORT.

We request the Tamil Nadu Government to publish an annual:

"Tamil Nadu SC/ST Atrocity Prevention and Justice Report"

The report should contain district-wise:

Number of SC atrocity cases;

Number of ST atrocity cases;

Serious offences;

FIRs;

Investigations completed;

Charge-sheets;

Cases pending investigation;

Cases pending trial;

Convictions;

Acquittals;

Relief/compensation paid;

Victim rehabilitation;

Witness-protection measures;

Special Police Stations;

Special Courts;

Special Public Prosecutors; and

Atrocity-prone villages/areas.

10. ROLE OF THE 46 SC/ST MLAs.

We respectfully appeal to all 46 SC/ST Members of the Tamil Nadu Legislative Assembly to rise above party differences on this issue and jointly support a common minimum programme for SC/ST protection.

We request the Hon'ble SC/ST MLAs to:

Raise this issue in the Legislative Assembly;

Demand district-wise data on atrocities;

Demand dedicated SC/ST Police Stations;

Demand adequate Special Courts;

Demand adequate Special Public Prosecutors;

Demand strengthening of the State SC/ST Commission;

Raise cases of serious atrocities through appropriate legislative mechanisms;

Demand periodic Government reports on implementation of the PoA Act; and

Constitute an SC/ST MLAs Coordination Forum for monitoring these issues.

This should become a non-partisan constitutional justice issue, rather than a party-political issue.

11. OUR PRINCIPAL DEMAND.

We therefore respectfully request the Hon'ble Chief Minister and all Hon'ble SC/ST MLAs to support the following immediate programme:

"TAMIL NADU SC/ST JUSTICE AND PROTECTION MISSION"

Phase I

Dedicated SC/ST Special Police Stations in:

Dharmapuri – Coimbatore – Madurai – Virudhunagar

Phase II

Expansion to all districts identified as having a high incidence of SC/ST atrocities.

Alongside:

✓ Strengthened Exclusive Special Courts

✓ Dedicated Special Public Prosecutors

✓ Victim and Witness Protection

✓ District Atrocity Monitoring Committees

✓ Fully functional State SC/ST Commission

✓ Annual public accountability report

PRAYER

In the circumstances stated above, we humbly request the Hon'ble Chief Minister of Tamil Nadu and all Hon'ble SC/ST Members of the Legislative Assembly to take immediate action for:

1. Establishment of dedicated SC/ST Special Police Stations in atrocity-prone districts and areas;

2. Beginning the first phase in Dharmapuri, Coimbatore, Madurai and Virudhunagar;

3. Expansion of the system to other atrocity-prone districts based on official data;

4. Strengthening and, wherever necessary, increasing Exclusive Special Courts for SC/ST atrocity cases;

5. Appointment of adequate Special/Exclusive Special Public Prosecutors;

6. Strengthening victim and witness protection mechanisms;

7. Immediate filling of vacancies and strengthening of the Tamil Nadu State Commission for Scheduled Castes and Scheduled Tribes;

8. Establishment of district-level SC/ST Atrocity Monitoring Committees; and

9. Publication of an annual Tamil Nadu SC/ST Atrocity Prevention and Justice Report.

We believe that such a system would substantially strengthen the implementation of the Constitution and the SC/ST (Prevention of Atrocities) Act and would give confidence to vulnerable communities that justice, protection and dignity are guaranteed by the State.

We therefore request the Hon'ble Chief Minister and all Hon'ble SC/ST MLAs to treat this as an urgent matter of constitutional responsibility, social justice and protection of human dignity.
